USCIS makes another mistake

Timeline

After recieving my I130 approval, I was waiting the case to be at NVC since I129F was already had a case name number after a week. After waiting for 10 days and than getting hardcopy I read this:

''The petition has been approved. The petition indicates that the person for whom you are petitioning is in the USA and will apply for AOS. He or she should contact local USCIS office to obtaion form I485.........

If the person for whom you are petitiong decides to apply for a visa outside the US based on this petiotion, the petitioner should file form i824 Application for Action on an

Approved Application or Petition, with this office to request that we send the petition to NVC........''

So here I am when I never indicated that my spouse is in usa and she never visited usa. So not only these @#$%^&* (no civilised word for them) are asking us to file I824 which means $340 filing fee but the processing time for that is same as i130 which is feb 2008. The only good thing going for us is we have our K3 moved on to Consulate now. But we wanted to pursue for CR1 since that is better as well another option in case hope not but any problem with k3. Anyway anyone has suggestions please let us know. Thanks

what was your answer to question number 22 on your I-130? did you give them a consulate name?

Timeline

This is just the official format that USCIS send when they approve your I129f/k3. Now it’s up to you to follow the CR1/IR1 route or K3 route. If you choose K3 then you may apply for AOS later on when your spouse come to USA.
