denial of EAD??????

OH #######...just realized i DID put the wrong code in...did for K-1 option (a) (6), not ©(9)...

what happens now?...do i have to pay for the new application?...cause this one was included in the fee cause i was filing AOS...

No just send in a new application and include a copy of the NOA1 receipt from your I-485. Make sure you use the code C9. as long as you include that there is no fee.

All applications for interim benefits (EAD and AP) are fee free while awaiting AOS if the I-485 was filed on or after July 30, 2007. Just submit a copy of the AOS NOA with the new application.

07/19/2008 AOS, EAD, AP mailed to Chicago lock box

07/21/2008 AOS, EAD, AP were received

07/28/2008 NOA1 for AOS, EAD, AP

08/04/2008 Biometric appointment letter arrived

08/15/2008 Biometric at Santa Ana office

10/21/2008 No update since biometric- contacted a local congressman, the ombudsman

10/22/2008 Was able to do service request

10/23/2008 EAD was approved

10/24/2008 AOS interview letter arrived

11/26/2008 Renew my State ID

12/10/2008 AOS interview approved right away

I wonder why it took so long for them to process your case.

@ the end of May...but there was an RFE...apparently i was so distracted with moving into our new house that i screwed up that form too...so the last time they touched my I-485 was on July 30 when they received my requested evidence...am worried a bit about that too...

I think that it is the best to call up the customer service or make infopass and fix the problem. I guess that you got rejected because you put C6 instead of C9. Since you are filing AOS at the same time, I needed to put C9. This will be the biggest reason to denial. However, if you retype the application and attach your noa1 and biometric receipt, you should be fine.

Making an infopass appointment at your local office or calling the 1-800 (miss-info line) will not help at all. You need to refile the application for EAD and use the correct code C9 and include a photocopy of the NOA1 from your I-485 application.
