Update

I may have convinced my husband to file I130 and K3 at the same time.

Shipped it all ready for signature.

In K3 I overkilled it by providing fresh copies of translations and copies of certificates in addition of copy of I130 file.

Steve y Jessica if you are still there, what kind of mail did you sent the center?

(I am not familiar with the US post system, my husband probably is but would like to orient him)

about filing both together there is a little risk

-that they dont' take them

-that they take them but then that I130 has such a defect that they reject it later and don't send you NOA1 (missing signature, missing check)

-that they mismanage and only account for K3

will see, ready to try

without attorney because the attorney my husband wanted did not want to do it and would have delayed the filing.

himher - "The going-to-work happens after the green card arrives, so NO TIME SAVED. " is completely false. your passport is stamped with your A# on your POE. therefore, realistically (with CR-1), you can go to the SS office the next day and start working immediately.

Hello everybody!

I'm a new member of VJ, but I read some forumes before joining. I found this topic and decided to try to file both petitions together. It seems very logical that document can get the place without round trip.

The only thing I'd like to clean up is how to figure out the Service Center I should file documents to. If to follow I-129F instruction we would file to VSC (my husband is NM resident). The only thing confusing me is that there are four Service Centers in the States (+ Texas, California and Nebraska), and only two of them are mentioned in I-129F instruction.

Can anybody help me please?

For the end of the story I did update my signature with what happened

10-18-08 - Mailed I-130 & I-129F together to Vermont

10-20-08 - USPS packet received by Vermont service center

10-31-08 - still waiting for I130 check to be cashed

11-01-08 - realized from file copies that problems in files sent including check - hoping to get all returned

11-04-08 - heard from in laws that big enveloppe in the mail, sending it to me via Fedex

11-06-08 - received big enveloppe from inlaws, both files officially returned because I130 has to go to Chicago lockbox since Feb 2008

11-07-08 - reassembled I130 with properly written check and stand alone, plus some correction , sent back to husband for mailing

My husband says that it is because we did "multi" filing we got rejected

Maybe...

Still had his check been properly written I130 would maybe have got through

check was wrong, had 355 dollars written and three hundred fifty dollars in letter

from the return it seems they started processing I130 but stopped quickly.

sending both files together was a risk

we took it because I imagined we could gain quite a lot of time by putting both files together

it did not work

There are only 2 centers that process I130 for spouse and I129F

NM is processed by Vermont I think

did you file both petitions together already?

It did not work for us sending directly to Vermont Center

Thank you very much for your answer. I've already read about your problem with the check in another topic. I'm sorry to hear that.

As for us I can confess that we decided to have some risk and send both petitions together. We did it on October 25 and few days ago recieved NOA1 for our I-129F. It is dated by November 3. It is strange that they haven't sent anything about I-130 (because all was in he same envelope), but at least we have something. I think if it was a problem with acception of I-130 they wouldn't take our I-129F.

So I'll keep you informed about our case details.

I hope everything will be fine for you and you won't loose too much time because of resending your petitions.

Good luck!

well thanks a lot for your update.

hope it goes well for you.

Not having NOA1 for your I130 is kind of a problem

not sure what you should do about it.

-wait to see if I130 is returned?

-call for instructions?

I think we'll wait one more week. I wonder how they could take I-129F without taking I-130? In this case they don't have any provement that we've sent I-130?

Probably our petitions were separated for two different department one one of them works faster. I hope so.

If we don't have any news next week, my husband will try to call VSC.
