Sent AOS but never received NOA1 and biometric appointment

Timeline

It has been a month since we were told from the lawyer's office that the AOS papaerworks were sent and that was after Labour Day. We hired a lawyer to file the paperworks .We have not received the NOA1 and biometrics appointment from Chicago. We waited until the last week of September. We inquired at the bank, however, the check has not been cashed. Right then, we went to the office and inquired. We voiced out again our frustrations. They already upsets us causing all the delays from the beginning we filed. However, my lawyer said that they were already sent but she could not show us a proof of any receipt or a tracking record when they were sent. We assumed that they were sent by regular mail. She explained that it may be the busiest time and a lot of AOS applications. It is hard to believe but somehow, we should get at least the NOA1. She scheduled an infopass appointment on the 15th of October to inquire of our status. I am so worried and very :crying: upset. I doubt that they were mailed or it has gotten lost in the mail. Is this unusual? Thank you for your input.

When dealing with lawyers, anything is possible. My guess is that they either sent it, but not when they told you, or just forgot to send it at all. LAWYERS SUCK!!!

It can take up to a month to receive an NOA, so I wouldn't go crazy just yet.

When dealing with lawyers, anything is possible. My guess is that they either sent it, but not when they told you, or just forgot to send it at all. LAWYERS SUCK!!!

It can take up to a month to receive an NOA, so I wouldn't go crazy just yet.

I also am having a rather disappointing experience dealing with the lawyer I hired. You best bet is to put a stop-pay on those checks at this point, in my opinion. I filed the Thurs. before labor day and got the NOA right away, so there's something unusual about the delay you are experiencing. I am so sorry! Did you or the firm make copies of all the paperwork sent? If so, cancel those checks, and send it again as you are filing for the first time. I really don't think the wait should be THIS long. That seems totally unreasonable!

I agree that it's taking a while, if you are to believe the law firm re: when they sent it.

USCIS is always quick to cash your checks, even if they're slooooow with everything else :P.

I sent mine by usps mail on sept 29, arrived at chicago lockbox on oct 2, checks were processed oct 6.

I have a feeling that they're not being truthful. Or that your application was lost.

I agree. It's unusual that they haven't cashed the checks. The delay is beyond reasonable. It's lost or never mailed.

I'm sorry to tell you this but it is pretty certain that your application is lost, either at your lawyer's office or in mail. I'm pretty sure infopass will tell you they haven't received your application. My advice would be to prepare yourself for filng it again. Since you probably send in originals before, you might want to mention your 1st appication in your cover letter telling them it got lost in mail. It's sad but unfortunately happens sometimes.

hope this will work for you. Maybe other people have experience with this and are able to tell you what they have done when their application didn't arrive at USCIS.

A month is (unfortunately) not an unreasonable length of time to have not-yet received a NOA(1) - nor is it for not having a check cashed (again, unfortunately). Biometrics takes a little more time too (on average). I wouldn't presume the worst just yet.

FYI - Your package was sent to Chicago but you will not receive correspondence from Chicago - (It's simply a lock-box that forwards petitions to appropriate service centers.) :thumbs:
