LAST MINUTE HELP NEEDED with AOS

Hi Everyone,

So much has happened for Osvaldo and me over the last 3-4 weeks that I hardly know where begin. We had a wonderful wedding 3 weeks ago, and a short honeymoon at Lake Superior in northern Minnesota. Shortly after we got back I got sick with a pregnancy condition called pre-eclampsia. I had an emergency C-section at 33 weeks, was in the hospital for a week and was in danger of dying. Thankfully our baby is doing well, she is adorable with lots of shiny brown hair even though she is less than 4 lbs! She will be in the NICU for 3-4 more weeks. Her name is Elisa Paloma Perez. Once I get the time I will post some photos of our wedding and our baby.

Because of all the drama, we are now way behind in putting together Osvaldo's AOS paperwork. His visa expires on October 22, just 2 weeks from today, and I am feeling overwhelmed. In going through the AOS guide, there are 2 questions/problems we have:

1) We need a copy of his "NOA2 Approval for I-129F". We have an official-looking form entitled "I-797C, Notice of Action" that seems to say his I-129 is approved... is that the same thing? This was mailed to me after I submitted my petition for his visa.

2) As I understand it, we need the "Supplemental form to I-693" ( a vaccination record). Osvaldo surrendered all his documents at his POE in JFK and nothing was returned to him. So we have no record of his medical exam or vaccinations. Does that mean he needs to get all those vaccines again? What if it is not possible to get them all in the next week? Should we submit the packet without that form?

If anyone has any other advice on putting together the AOS papers in a hurry please let me know. We really need all the help we can get, and we are thankful to all of you.

Congratulations on your wedding and your new baby! My niece was also born at 32 weeks and weighed 3.8 lbs. She's not a very hyper and lovely little 3 year-old girl. :star:

I also wanted to tell you that even though your husband's I-94 will expire in two weeks, you can still take your time with filing for AOS. You don't have to do it within the 90 days upon entry as long as you got married within that time frame.

1. Yes, that is your NOA2. Only send a photo copy of it.

2. He needs records of his vaccines. Is it possible to get it from the doctor who did the medical back in Cuba? If not, then I'm afraid he'll have to get another round of shots and have them approved by a civil surgeon.

congratulations on your wedding and baby hope she remains healthy and is home with you soon.

i just went through the medical thing w/ my husband about 2 weeks ago. if you are not able to get copies of the foreign medical, you don't actually have to have another round of shots. a lab can give him a blood test called mmr antibody test. it will definitively prove that he has been immunised it takes about 2-3 days to get the result but in the mean time the civil surgeon can administer the tb test and in 3 days for that result you will get your i-693 filled up so we had it all completed in about a week.

also fyi as long as you got married w/in the 90 days for a k-1 you don't HAVE to mail the aos in the 90days there won't be a penalty but as soon as you can it is recommended.

Great info Kang Lang! So the lab results will show all the shots that were given prior to the visa interview? Ot is it just for a specific set of vaccines? :huh:

Also, where can this be done? Any lab in particular?

any lab will be fine, our cs tried to get us to go to a lab he was connected to but they were not covered by our insurance and would have been expensive. we went to one covered by insurance and my husband didn't have to pay anything not even a co-pay. they also did the hiv/hep & syphillis testing too since they had a new sample of blood. those cover the i-693 form pretty much the rest of it is pretty much general health.

Thanks SO much, that's a huge relief to know we have more time.

Is it true that we must apply for his SSN before his visa expires? Maybe that should be our priority right now.

True. But his I-94 has to have 2 weeks left on it before it expires or they won't assign him a number unless he has at least his EAD.

So once the beneficiary goes to have these tests done, all they have to do is mail the results along with the AOS package?

the cs will give you a sealed envelope and you must keep it sealed and submit it w/ your i-485 (but don't forget to ask for a copy! ;)) but all in all since we didn't have the old form it was really painless!

Great info Kang Lang, I really appreciate it! My husban came in with a CR1 visa over a year ago so we didn't need to file for AOS but I've seen a few people here on VJ who lost or never received a copy of their vaccine worksheet and didn't know what to do.
