My husband petitoned me while still owing back child support, what a dead beat! And yet, here I am! :) Smile, you're on candid camera.

If the divorce was in WA state-he may be in contempt of court for not following the "parenting plan" set in place....that in itself could hold up the petition.

If a parent fails to comply with a provision of a parenting plan or a child support order, the other parent's obligations under the parenting plan or the child support order are not affected. Failure to comply with a provision in a parenting plan or a child support order may result in a finding of contempt of court.

Still begs the question, how can he sign an affadavit of support and swear it in, when he is in arrears to his own blood?

If a person, man or woman, takes it upon himself to produce a child, should make sure that the child they created has food in their mouth. :angry: Should the child suffer because either the mother and father can so easily throw away a flesh and blood responsibility so easily?

as what ive said, its their love child.... the daughter is now in the good hands of her mother since her mother is very high maintenance woman... good thing im just simple yet lovely wife :star: hehe

The daughter should be given the best life possible and living a good life. She is a child. She deserves it, if at all possible..... and it is good that the father is now responsibly paying. I know you feel that way too, right?

yes madam, everyday i was hoping that the mother will post a new picture of the daughter, i keep asking her but she refuse.... i dunno when this will really solve.... maybe when my feet was already in the ground of US... things will be change.. My husband made a lot of videos for his daughter so that one day if she asked where is her dad.... i can show her the videos.....

Okay, I think I understand now. He is being responsible, and does pay child support. Kudos to him. I do find it a shame when a mother doesn't allow the father rights to his child. All you can do is keep paying, keep proof of payment. And hope that some day this child will insist on seeing her father. Then it is still important to respect her mother no matter what the feelings are. Keeping a video is a great idea so that she can see her father and his thoughts throughout the time apart.

My brother had a set of twins with his wife. After the divorce she refused him visitation, but he continued his responsibility to pay child support. Now the children are grown. Right after their 18th birthday they showed up at his door. Since then they have become very close. He is always respectful of their mother no matter how he feels. She is, not matter how he feels, their mother.

Some would say that spending time and being part of a child's life...as well as making monetary contributions to a child are both very important.

But I'm wondering, if you had to prioritize these two aspects of being a non-custodial parent, which one would you say is most important?

Contributing time or money?

Or is contributing time not a requirement of being a respectful non-custodial parent?

I think it takes both time and support. My son's father is roughly 9 years in arrears on child support for my son. I have never withheld time from him, and I never will (my son is 17 now). However, my son has learned on his own his father's faults, not from me. Regardless of how I feel about his father, it's up to them to have a relationship or not.

But, all these years I have worked my butt off to care for my son, sometimes 2 or 3 jobs at a time, because his father didn't 'have enough money' for child support. He had enough for drugs, parties, and traveling, but not for child support.

If the non-custodial parent (mother OR father...because sometimes it's the mom who pays support) isn't able to pay their full support (or any) but is still trying to be in the child's life, it's hateful and hurtful to the child to take away visitation. If the non-custodial parent is just an azz who chooses not to pay support, that's a different issue and mayhaps in the long run, the child is better off....

Well according to my ex-fiance and father of my daughter...if he can't be involved in raising her on a day to day basis (ie marriage to me) then he has no further responsibilities towards her. I made the decision not to marry him so I'm the one with the burden of raising her alone. So it's my fault, not his. Of course this is coming from a whole different culture. If he were American that wouldn't fly in the courts at all :P

A man that doesn't have respect for his child won't have any more respect for a wife. In fact he is more apt to leave when the next wife has a child and leave her without any support either. A lot of these guys like leaving kids scattered about and brag about how many bay mommas they have. They think the tax payers should be buying the diapers.

in 1994 i threw my first wife out for unacceptable behaviour. i was awarded custody of our children immediately by court order. i filed for and was granted support 8 months later after she (a police person) and her police officer BF filed 11 false summary charges against his wife (who had custody of their children) and myself in a 5 month period in 4 different magesterial districts. i also filed for and was granted a restraining order against both of them as a result of their abuse of process. they both lost their jobs and fell further behind in support as a result of the restraining order, which detailed their systematic harrasment by malicious prosecution.

in the follwing 7 years, she was never less than $800 in arrears in support. by 2002 she had discovered that being an a$$hole and living with one was a maladaptive solution. she demonstrated true remorse, so i helped her out and eventually transferred primary custody of the two younger of the three children to her and forgave 1400$ in back support due. i immediately began to pay child support, and was only in arrears for the two months it took to process the case. in the first 2 years i paid more than she did in 7.

from what i have seen, it's the non-custodial mothers that are the deadbeats. the york county penna child support enforcement office confirmed with statistical analysis that women without custody are 4-5 times as likely to be in arrears as men in the same situation. that was in 1999, or so. in penna, about 15% of children are in custody of their father after parent's divorce.

Since it is I who have custody, and my wife who is behind in her child support obligations, this little law didn't affect us.
