H.R. 78 (American Child Support Enforcement Immigration Act of 2006)

This Act was first introduced in the House on Jan 4, 2007. After being referred to a several other committees, it was finally referred to the Subcommittee on Immigration, Citizenship, Refugees, Border Security, and International Law on Feb 2, 2007. It has had no further action since then.

It is not currently and possibly may never be a law.

If the divorce was in WA state-he may be in contempt of court for not following the "parenting plan" set in place....that in itself could hold up the petition.

If a parent fails to comply with a provision of a parenting plan or a child support order, the other parent's obligations under the parenting plan or the child support order are not affected. Failure to comply with a provision in a parenting plan or a child support order may result in a finding of contempt of court.

Still begs the question, how can he sign an affadavit of support and swear it in, when he is in arrears to his own blood?

no arrangement since the mother is not ready to introduce their daughter to my husband which hurts me also... my husband is upset but i tried to be friend with the mother upto this time and i think this will take some years for this to be totally solved.

It should have been addressed in the divorce document. Non-payment of child support does not give the custodial parent the right to with hold the child from the non-custodial parent. If he is supporting the child now, and if he genuinely wants to see his child, why doesn't he make an application to the courts to enforce the visitation agreement in the decree? has he even attempted to try enforcement methods to gain access to his child. he shopuld know that unless he is a heinous criminal, druggie or whatever, he is within his rights.

I feel more strongly about this next part.....really-what is he thinking even petioning and signing an affadavit of support for someone else---when he is behind with his support for his own blood?

I can see where the Govt is coming from on this.

eta-you are very descriptive about the ex---have you met her? She must have been OK at one point-he married her and they produced offspring. If you are only judging her by his word.....well, you know where I am going with this.....

My husband didnt marry the mother... its their love child when he was only 17... he is now 25 yrs old.. my husband is doing his best for the him to see the child but the mother refuse ever... ####### again for that huh

as what ive said, its their love child.... the daughter is now in the good hands of her mother since her mother is very high maintenance woman... good thing im just simple yet lovely wife :star: hehe

I am confused by your reply. Are you saying that it is alright not to pay child support since her mother is high maintenance? I hope I read that wrong.
