Wow, this all happened fast!

my thoughts to you is to prep what you'd need for a co-sponsor just for peace of mind so if USCIS suddenly decides it wants to send you an RFE based on your DH's newly ineligibility, you've got the whole shebang ready to fire off ASAP and thus won't experience a delay while people rush around to gather the co-sponsor stuff.

You probably won't even need it, but it might be comforting to have something productive to do, as well as insurance against you needing it later.

18/05/2008: POE - Harassed by ignorant and incompetent Customs Official who grilled me until I answered that the reason why I broke up w/ my Ex was not to date my USC but b/c he was "impotent from a porn addiction". He also insulted my husband's motives for talking to me, dismissed our 2 years together as "not enough to get married", and otherwise trotted out the Spanish Inquisition.

Well as I'm sure you've figured out by now, but I'll just add my 2 cents anyway, you don't need to notify USCIS of anything. You'd need to take updated documents with you to an interview anyhow, so if you get called for an internview, take a new I-865 with your co-sponsor's info with you instead of only your hubby's (you'll need both, he's still considered the primary sponsor).

Enjoy the time together while you sort out new jobs and whatnot, and go eat some chocolate! Chocolate fixes everything! :yes:

As other mentionned about the AOS I wouldn't bother calling them to change anything. You sent paperwork that was current at the time of filling and they will either

1- Approve you without bothering, and then file accordingly when you remove your conditions in 2 years.

2- Schedule an interview and then you can bring the updated affidavit with your new sponsorship from Nick's parents.

I'm so sorry this happened to you! What a birthday present. You've gotten good advice. Just be prepared if they do call you in for an interview or send an RFE. Unfortunately these events are happening to many people right now. My prayers are with you.

I just read this and sorry for what you guys are going trough , but glad to see you keep your heads up ,

cose like others here said it aint a biggy , they will only request new documents if the give you an interview

lots of people here didnt get an interview ( me included was easy I send all the documents they required never got an rfe went to biometrics , got transverd then poof aproved without interview )

my advice is do like others said have the updated documents ready incase they give you an interview , if not great

but I wouldnt worry about it like you said you guys got cash and a sponser , so no biggy ;) good luck and late happy b day to your husband :)

Hi LauraandNick,

I'm sorry that this had to happen to you and your family. (((hugs))). I do hope that you will find the strength to be able to overcome this unemployment/financial situation. And I hope too, that Nick and you will be able to find employment soon too. On the bright side, at least you got to spend Nick's special birthday together (and more time together overall), which probably cheered him up to have you be there for him when he needed you to be.

As for sponsorship, well...technically, at the time that you signed and sent in the form, your husband was still working and was working before for the last few years, so I would see the I-864 that you signed before as truthful and that they more likely than not should approve it based on that one sponsorship only.

By the way, did you know that for AOS sponsorship, they average one's income amount (to be over the poverty level) over the entire year, even if they only work for part of the year? For example, if your husband worked 10 months out of 12 for this year, then they will average that out, and if that number is above the poverty level, then you're covered that way too.

However, at the time of the AOS interview (my guess is that it will be about 2-3 months later since you got your NOAs recently), they might question you and your husband about current and future employment. And if his income level isn't sufficient enough for sponsorship, then yes, a co-sponsor is needed. You're lucky that you have one already lined up for you, so you don't have to frantically search for one now. During the interview, you can explain your husband's situation (I'm sure that they can understand that people get unemployed at times). And also have with you another filled out and signed I-864 sponsor form from your co-sponsor too, just in case they do ask for a co-sponsor.

I just got my NOA's for AOS, AP and EAD and today....on Nick's 30th Birthday....he got laid off work.

He works in the auto industry, parts department.......

I'm freaking out....what do we do?

Sponsorship...do I have to contact the USCIS and let them know he isn't working....I'm scared.....
