So I took my wife to get her ssn# over three weeks before her I-94 was about to expire. The guy that worked gave us no trouble, even though we went after we got married. However, yesterday we received a letter from them saying that they can't issue my wife a ssn# since her Legal immigration status will expire before SSN card can be issued to her. I don't understand why, her I-94 expires on Oct 14th and that' exactly why we went there around September 29th. He told us that she will get the card within two weeks but instead of receiving a card, we got this letter. It says what we can call and have a different person review our case but today is Oct 8th and her I-94 is only valid for couple more days. What should we do? Is it ok to wait and get a card once she receives a green card or it's necessary to have a ssn# before we send I-485 package?

You can wait. We had the same basic issues. We filed AOS and once the green card came, we made a trip back to the SSA and got the number with no issues.

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right

You only get one trip

So make it good, make it last 'cause it all flies by so fast

You only get one trip

September 29th is not over three weeks but a mere 16 days from I-94 expiry.... That as you came to discover was too close... The SSN must be issued before the expiration of the I-94 including all required checks.. typically that is two weeks or less but occasionally that time is exceeded and the result you experienced happens

YMMV

Same thing happened to us. Except, we had applied 9 weeks before the I-94 was going to expire. Yet, by the time that the SSO got to processing the SSN, it was within the two week window and we got the same letter. So, we are now waiting for the EAD or AOS to come and go reapply. Annoying, eh?

SSA will not assign an SSN or issue a card if your status has expired or is within 14 days of expiring at the time they are going to clear the application. If you cut it to close to the 76th day to apply as these people have found out you are likely to reach the 76th day waiting for your status to be verified.

This is why you should apply as soon as you can, since you have no idea how long it's going to take to verify your status. If as some people have worried about having to make two trips to the SSA office and wait until they are married to apply, you might come up empty handed. Then have to wait until you have an EAD card or I-551 stamp or card.

Nothing, wait for the EAD or greencard. You can apply for AOS without a SSN. Just write "NONE" in the fields it asks for SSN.

You should have applied the day she entered the country.

We applied the day after my fiance entered the country - she had her card in 2 weeks, about a month before we were married.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.
