According to the law 962 of 2005, Colombia authorized the possibility to get divorce in a notary when the couple agrees to ask for it. This option was created as a tool to avoid the procedure in court, which always takes time and have more cost.But is it a reality that you can get divorced in 2 hours?

In real life, it is not, a normal divorce when the couple accepts to fill and sign the documents takes as min 2 days in the notary. This is in when the couple doesn’t have kids or assets, plus another week to register the public document in the notaries where the marriage and birth certificates are stored.

In case there are children, the mutual agreement divorce can take 3 weeks because the social worker has to provide a concept of the section of child support, plus when the couple has assets, the liquidation of the community must be done at the notary and registered in the office of public instruments.

It is important to mention that the Express divorce also was made as an instrument to assist people who live outside Colombia, but the preparation of the documents for the divorce must be made by an experienced lawyer who knows what and how to request and write legal papers.

As a fact like in many posts , if you want to get divorce hire a lawyer with knowledge and “contacts in notaries”. Sometimes there are certain notaries that refuse to handle this type of cases that involve international law, making the person come to Colombia and sign the papers in front of them, situation that a good lawyer can make the notary to omit.
