New Delhi Interview excessive document request

My fiancé just had a horrible experience with his k-1 interview at the New Delhi embassy. The interview was incredibly rude and even ordered him to “stop smiling” during the interview (he is a good natured fellow who almost always has a smile on his face). The interviewer found nothing whatsoever flawed in our documents, but is still demanding tons more materials from us, including, among many, many other things, voters lists for the past 5 years with his name on it to complement the half a dozen other forms of identity proof he has already given, and notarized statements from our parents saying that they approve of our marriage (I am 28 and he is 31!) They also demanding more proof of relationship, when we already have given boarding passes, tickets, pictures, and reservations for a trip we took together, a skype call log showing long daily conversations extending back almost a year, and boarding passes from four different trips he took to visit me while I was away in another city for the summer! And this is India, where many of these petitions are for arranged marriages in which there is no past relationship at all! I’m getting very frightened that they are just looking for an excuse to reject his application. He is Muslim, so part of me is concerned that that may be a factor as well.

Have other people had these types of experiences with demands going above and beyond the basic requirements put forth at the interview? Should I try to hire a lawyer or is it too late in the game? Also, no one even bothered explaining to him whether he will need to come in for another interview after submitting the materials. Does anyone know what the standard process is?

Both of us are feeling pretty crestfallen and vulnerable right now, so any advice or even shared similar experiences would be much appreciated...

Yes, Delhi has some really awful stories of these kinds. Sorry to hear what your fiance had to endure.

About your question, no, he won't be asked for a second interview. Your fiance has to submit all his documents at VFS within 4 month expire period of your approved 129-F.

As others do, just make sure you load them with all the papers possible, don't just take affidavits from parents, but also take affidavits from friends if possible.

All the documentation which were asked from your fiance, it seems like he has a common Muslim name, so even though you submit all your papers at VFS, please still be prepared for AP (administrative process). Since CO was insisting on names and things like that, it is very likely that your fiance may be put for extra review.

Please be positive and don't give up (F)

We had almost the exact same thing happen to us.

Granted we were not going through India, but we were told that we had "overwhelming evidence" but STILL had to bring in snail mail letters that we had sent to each other. My SO was given a date to come back, he presented the letters and was given the visa.

this makes me nervous about my own petition. if they were rude like that for no appearant reason they were probably trying to find a flaw. i have only heard a few bad stories from delhi dcf but now that i am here starting my 3 month wait i am interested in any and all info.

i dont mean to be rude by saying this but is your husband a skilled worker in india. my first assumption would be that they are being discriminant for some specific reason toward him.

Sorry to hear that. You guys look like a really cute couple, and you obviously had a lot of evidence.

It's rare for a petition to be flat out denied if everything is in order, but I think what a lot of USCIS or embassy officers hope to do is delay your petition for so long or make it so difficult for you that you'll eventually give up. I imagine some officers are also prejudiced against certain applicants and will look for any possible excuse to delay or deny the application. (Or maybe because of the large number of applications coming in, they want to try to accept as few as possible.)

Anyway, I guess all you can do is collect all of the extra stuff they asked for and try to submit as much evidence as you can possibly come up with. It wouldn't be a bad idea to get in touch with a couple of good, reputable immigration attorneys. You don't have to hire one, but just explain your situation and see if they think they can help or if there's anything you can do. Most immigration law firms offer free consultations.

A lawyer cannot help, now or ever. They have made their demands and a lawyer cannot get them to change that, nor does a lawyer have the documents you need to provide. Any immigration attorney will be happy to take lots of your money though. Best bet is to provide each and every thing they ask for within the time allowed.
