Filed: K-1 Visa Country: Philippines
Timeline

I was arrested for assault 16 years and the charge was dismissed ( no conviction) . I answered no on the 129 because of no conviction. But the arrest record is still there . Would that have any bearing on my K1.....I'm the sponser......thanks

You answered correctly because you were not convicted of the crime. However, you still may receive an RFE for more information about the incident. One of the resons why it takes so long to process the petition is it takes that long to perform the national agency check through the FBI. Good luck on your petition.

If you are sure it was dismissed with no plea bargin or deferred sentence you are fine and you should have no arrest record from it if the charge was dismissed.

If you are sure it was dismissed with no plea bargin or deferred sentence you are fine and you should have no arrest record from it if the charge was dismissed.

Theres an arrest record saying it was dismissed...For 1500 dollars I can have it expunged but if I dont have to I wont....

The form also says this:

Answering this question is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law

enforcement officer, or attorney, told you that you no longer have a record.

Which would include "expunged." However, since there is no conviction (the imperative word), then you should experience no issue.....

I agree with everyone that you should be fine since there was no conviction. However, I would be prepared to send them all your supporting documentation that the case was dismissed just in case.

We were advised regarding getting things expunged, that it would still show on your criminal record so bit of a waste of time and money trying to do it.

Records are kept of every arrest even if its dismissed, it should say dismissed at the side of the arrest.

I had something in my past also, bout 20 years ago.

I went to court and judge dismissed the case after about 20 minutes after the trail started.

I didn't report it on my paperwork, and it was never mentioned.

Nor have I had any issues since then, I have had my fingerprints sent to the FBI for clearance on a professional licensces in Texas, and never had had to send supporting documents

I think you should be good to go.....
