My final destination is Seattle as my fiancee stays there...but I am very keen to get EAD (work permit) stamp on JFK airport only because I heard that on JFK everyone gets EAD stamp.....if I go directly to Seattle I might not get EAD.so my question is

do I have to buy a ticket from India to JFK and than buy a separate ticket for JFK to SEAttle?

or I can buy a single ticket from India to JFK to SEA? in this case there is hold for 3-4 hours on JFK airport before flight departs for Seattle...

My main worry is...if I buy a single ticket (India-JFK-SEA) they might tell me to get documents stamped on Seattle airport and if they do so I am worried on Seattle airport they won't give EAD (work permit ) stamp...

Please clarify...

Hope my question is clear to all of you...

Regards,

Vikas.

Why are you worried... Your POE is the first US airport you arrive at...

I would only go through the trouble of making JFK my POE if I had a set job with an employer who is willing to hire me as soon as I land, and who won't mind losing me after three months of employment until my EAD is approved. Otherwise, is not worth it.

The first airport you arrive in (in the US) will be your POE (Port of Entry, documents stamped, etc), all other airports after that are simply domestic flights (no Customs and Border Patrol check points).

Well thanks for quick response...

you mention my POE is the first airport ...so that means even if I choose a continuous (single ) flight ...the first US airport e.g. JFK will be my POE and thats where they will stamp my documents correct?

if you are experienced can you tell me what will they check at JFK airport and what will they stamp?

aye. From the multitude of threads posted on this topic by the OP, I am not convinced that he understands that the EAD stamp is temporary in nature.

why do u say its not worth it?

is it because they charge 330 us$ to issue temporary EAD?

It's not (usually) 'worth it' because very few employers will hire an individual holding a temporary (90-days) employment status. So, if very few, if any, will hire you - what good does it do? (Same goes for obtaining a Temporary EAD by filing for one.)

Do you have employment arranged when you arrive?

No, because most people do not benefit from this as it is valid for 90 days. If it is issued, it is issued FOC.

At your first airport, they will check all your arrival documents and stamp everything that is required to provide you legal entry and authorized stay...

YMMV

The EAD stamp that JFK issue is only temporary and will last 3 months. You still have to apply for EAD after marriage. Most people say it it not worth it unless you have a job lined up. I not expecting to work for at least 6mths after entry into the US.

the temporary EAD stamp -- the one you are so keen on getting -- is free. But it expires when your I-94 expires, which will be 90 days after you enter the USA. And you will not be able to use it until you get a SSN, at that takes some time as well (your name will not be in the system for at least 2 weeks after you enter the US).

the EAD card -- the one you actually want -- does cost money, it takes time to process and receive.

If your temporary EAD expires before you receive your EAD card -- which usually happens, because it is taking about 3 months (or more) to process the EAD card -- you will have to stop working because you will not be eligible to work, and you have to wait until you get your EAD in hand. That is why a lot of people don't think it is worth the time and energy and expense to make sure they go through JFK as their POE to get the temporary EAD stamp.

Exactly. The thing is the temporary EAD they give you at JFK is only good for 90 days from the day you land. By the time you get married, file for AOS and get your EAD approved by the USCIS, your temporary EAD would have been expired long ago because it takes at least 3 months for EAD approval. So it's very difficult to have an employer hire you for less than 90 days, let you go because you no longer have permission to work until you get your EAD approved and then re-hire you months later once you get you get your EAD. Some may do it, but most won't because it would be a waste of their time to hire someone for a couple of months.
