My question is an income tax question.

Do they look at the gross Income, or net income when qualifying as a joint sponsor to support a spouse?

We filed for AOS and got our appointment for the interview.

When we filed for AOS our joint-sponsor was still married and earned enough to sponsor me.

Now he is divorced. His gross income didn't change but he has to pay so much child support that his

net income doesn't even meet the poverty line anymore. :blink:

Now we are worried that they are going to look at his paystubs where it shows his new net income and they deny me at the interview. :crying:

I'm totally desperate. :(

Never have figured out why USCIS would go by total income as you will be living on the money you end up after deductions and writeoffs.

What am I missing?
