Relationship between EAD and BACKGROUND CHECK???

Hi everyone sorry if this was answered before. I was just wondering if EAD was approved and you're allowed to work and everything, does that mean that the background check is done? For example, if they give an individual a work permit and they allow that individual to be inside an institution and be dealing with alot of people of course it would mean that that person is not a treat or a terrorist right? Or does the background check has no bearing with EAD being approved? Is it just for the AOS processing? THanks in advance for your insights. :thumbs:

Good question, I'd think if they issued you an EAD then they must have already done a background check...I doubt they're that careless...they need to know who they have working in their country LOL

Timeline

Some people have approved AOS pending FBI namechecks but have EAD and they can renew it.

The EAD is an interim benefit while AOS is processing.

Yep...i've noticed a lot of ppl receive greencard/interview letter about a month or so after receiving ead...so heads up your almost done :thumbs: ...and yeah it also help that you had no rfe's (like i did, :blush: )

Aww thanks, i hope so....also it makes no since to allow someone to receive EAD if namecheck hasn't been done...i don't know, just my thought...suppose later on they find out that person has a questionable background (i don't know terrorist or something), i think if that's how they do it it's backwards...why not do the name check first thenapprove EAD based on the outcome of background check...

Well, let me try to answer it to the best of my ability.

There are several checks not one. When you come into the country with a visa, checks are already performed on you but while in AOS they are expired. Normally for EAD they do not require to have the background checks current but for AOS they need to have the background checks current to approve the application. Search for adjudicator's manual on google and you will find some interesting documents.

The background checks for jobs are pretty pointless. Here, we do them all the time. But, they only cover the US.

I-765 (EAD) applications are subjected to IBIS (Interagency Border Inspection System) and Fingerprinting checks while AOS also includes FBI namecheck.
