I have recently received the NOA-2 for my spouse for my I-129F and I-130. I have decided to pursue the K-3 and I-129F cause I want my wife to come asap! So, should I still move forward w/ the I-130 anyways even though I've made up my mind? Will paying the AOS fee, etc.. somehow benefit me or shorten my process for AOS once she arrives on the K-3 visa??

Paying the AOS fee and CR-1 visa fee may net you the CR-1, I have seen many cases where the I-130 shows up at consulate before K-3 interview, if this happens the K-3 gets dropped in favor of the CR-1.

If you are dead set on the K3 with its adjustment of status, and 90+ day wait for things like EAD, then dont bother paying and doing the I-864 with NVC.

CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

K-3:

I-130: $355

I-129F: NONE

AOS: $1010

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

I see many posts from K-3 holders stating, "Wow this sucks, I an stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

you want to go through the agony of AOS and EAD and no DL for the 3+ months after she gets here?? if u follow the NVC guidlines on this website (courtesy of some great members...read the guide by Ling Ling), you could be out of NVC and be in the same position as a K3 filer in about a month and a half. some people have claimed to be out of NVC in 3 weeks.

the choice is urs but i would suggest you spend that extra few weeks and just do CR-1 and get this nonsense over with. you have already spent so many days without ur wife, just suck it up for a few more weeks. i dont know if you want to deal with yet another few months of VSC...many VJers certainly dont.

I appreciate both your advice and I will definitely take that into consideration but if I am deadset against waiting one more day than I have to for my wife to come....is there any benefit in still going forward with the AOS fee, I-864, etc now? Will that speed up the process for when she is here and I do the adjustment of status process completely? I hope you all get my point..

It wont speed anything up, I-129F passes through NVC separately from I-130, I-864 fee is for the I-130 process, not I-129F. You would simply be tossing $70 at NVC for no reason.

I'm totally with you. To me it was worth a lot more to have my husband next to me, that's why we went with the K3. AOS was nothing, it was not a big deal to us. Just let the 1-129F go through NVC, it just stays there from 3 to 5 days (where the I-130 stays there for over a month) and then it's forwarded to the foreign embassy. Your embassy will then schedule the appointment. Many embassies have a priority in setting interviews faster for the K3 than for the CR1. In our case, it would have been an additional 3 months in the Juarez (Mexico) embassy to wait for a CR1 visa appointment. I'm very happy we chose K3, it got him 4 to 5 months sooner than the CR1....

We did both. We did everything that was required at the embassy for the K3, but at the same time, we completed the process for the CR1 through the NVC. Our case was complete at the NVC before the K3 interview, so our K3 interview was changed to the CR1 interview. My wife received the CR1 and it did not take 1 second longer that the K3.
