Here's a puzzling question. Is is possible to work for a Bermudian company remotely without an EAD?

My boss asked if I would be willing to do some projects that can be done over VPN while I wait to be able to get a job. I haven't the foggiest idea if this is something I'd get in trouble for.

You cannot work in the USA end of story. You cannot volunteer either!

Sorry if I seem abrupt but I have been waiting almost 5 months for my ead and have been given the same abrupt answers.

Yes, it is the same thing as if you were visiting the USA and did some work for your employer back home, the company is NOT US based, and you are NOT a US resident yet.

You cannot work for an American employer in the US without an EAD. Many Canadians have continued to work for their Canadian employers through online/distance work while waiting for their AOS to be processed or while crossing back into Canada daily to work while on a K-3. There is actually an option on the Affidavit of Support that allows the applicant to self-sponsor if the source of income is going to be the same after PR status in the US as before - in other words that their employment source continues. It does not specify between American and non- American sourced income.

And yes, you CAN volunteer while you are waiting for your EAD. You cannot volunteer at a job for which you could normally be paid or that someone else would be paid, but you can do honest volunteer work which would normally not be paid to anyone. I volunteered and I know a number of other VJers have volunteered waiting for EADs to be processed.

The EAD is to protect American jobs. The US does not have say over who a foreign employer can hire outside of the US, especially if the employment is a continuation of existing employment and does not take a job away from an American. Keeping on working for your former employer does not take a job away from an American.

There is a lot of controversy over this particular situation and some will tell you that you cannot work at all; I just know that there have been many Canadians who have continued to work for their Canadian employers - some at a distance and some by travelling back and forth to Canada while on a K-3 waiting for their AOS to process. None of them have had any problems.
