Hi,

I have tried to read the different CR-1 threads but I still have a question or two.

I'm in the USA on an F-1 visa, working under OPT. I'm getting married October 31 (how funny is that!) to my American boyfriend/father of our child and do not see leaving the country for even a day an option. From what I can understand CR-1 is the cheapest way to go and probably as fast as any other way.

When filing the I-130 do I send of the DS-230 along with that and all the GS-325 etc or do I wait?

Do I need to file for AOS or how does the whole work permit get approved? I don't think it will be cheaper to if I have to file for the work permit too and will just do the whole I-130, I-485 etc. thing but was trying to keep costs down. Also, from what I understand, by filing CR-1 I can work upon entry in the USA. Since I'm already here, does that mean I can work as soon as they receive my application?

Thank you for any help on this matter.

AOS:

11/07/2008: Filled AOS @ Chicago Lock box

11/11/2008: Received @ Lockbox

11/18/2008: NOA for I-130, I-485, I-765

12/08/2008: Biomtrics appointment

You do not need a visa as you are already here and do not want to leave... A visa is needed to present yourself at the border to request entry. You need your status adjusted after marriage.... I-130, I-485, I-765. Read the adjustment of status guides

YMMV

 Not as soon as they receive application, you can work shortly after you arrive on a CR-1 visa because it gets an I-551 stamp.

If you are already in the USA, the easiest thing to do is follow the "Other visa" AOS guide: http://www.visajourney.com/forums/index.ph...page=i130guide2
