A new member here.Im under k-1 visa married to another USC few weeks ago. My I-194 will expire on the 20th of this month. .We went to USCIS to let them know how my relationship with my petitioner ended and why I end up marrying another man..The In-charge whom we talked to was so nice and friendly but I didn't agree with her when she said I can stay in the USA and can file the I-130 and I-485 which she handed to us to fill it up. My husband want me to stay here but I want to go home.

I need an immigration lawyer .Please advice me on what to do.. Thank you for any help you can give.

Did you marry the petitioner? It is not very clear from your post.

Unless there are facts related to the relationship to the initial petitioner that would allow you to adjust status without his participation, which you've not shared with us, the immigration officer was mistaken. You would not be able to adjust your status while here in the USA, if you married someone other than the petitioner.

Sounds like you came here on a K-1 and then married someone else? Is that right?

If so, you do have to go back and start over with the K-3 or CR-1.

Your suspicion is correct. If you did not marry the U.S. citizen who filed the K-1 fiancee petition on your behalf, or if you married another U.S. citizen or lawful permanent resident, you are not eligible to adjust status in the U.S.

Attorney or no attorney, the avenue to greencard for you is currently closed.

Well, you are going to get your wish then and go back home. There is nothing you can do from the US now. In fact, you have no status whatsoever right now.

I didn't marry the original petitioner( verbally abusive). I formally broke up with him and asked permission to go back to my country, didn't give any money when I left.. I contacted my long time friend(Fil-Am USC, who is now my husband)and asked help for a shelter in a few days before going back home. Days turned into a month, I end up marrying him. I don't want to overstay my visa here which will expire on the 20th. I doubt the local USCIS representative who told us didn't know about the Immigration laws since I questioned her about it.

Do we need a waiver if we go in the K-3 or IR-1 route since I married someone else?..

A waiver for what? Once you depart the US any status you presently have is gone. You may get extra scrutiny from the USEM but unless you overstay your visa you have technically not yet done anything that will require a waiver

Thank you so much for all the advice given here. I will tell my husband so I can go back to my country next week.mI felt nervous here since I don't know what to do at all. Another filipina told me to look on this site which I did and it's worthy. Again, thank you for the help.

Your husband can go ahead and file the I-130 as soon as you are ready and getting ready before you leave will make things a bit easier. You must leave before your I-94 expires though. I would seriously consider the CR1 visa path instead of the K3.

No, you won't need a waiver but if I were your husband, I'd include a letter explaining how you met. You could also include one in your own words explaining the events leading up to your current marriage.

Facts are cheap...knowing how to use them is precious...

I'm sorry it didnt work out with the petitioner, certainly going home and playing the waiting game all over again is not fun. But I'm kind of interested in why people when they split believe they should be given money? I read it frequently in this forum. Man or woman, when they leave bitter, they say "and he/she didnt even give me any money." Is it someones responsibility to give you money? We are all adults and responsible for ourselves, why does the immigrant seek a handout at departure?

That probably has a lot to do with moving to a "rich" country from a poor country, having no job or way to support yourself, and most likely no real savings. The person is NOT married and so probably can't work legally, and hasn't had a chance to get established... that's why I'd expect money in that situation... or really, a plane ticket home.

As to people coming to the US on a K-1 and marrying someone besides the petitioner... I find that weird, but at least thre is an explaination of it here (her fiance was verbally abusive and she married a long time friend, suspicious sure but it's not really my job to judge).

Well I don't know if its the same person, its just the same story. I don't understand how some people come here to marry one person and then marry someone else.

I understand if a relationship doesn't work out. Go home. Don't stick around and marry someone else.

At least you're not out of status like the previous woman.
