Another affidavit, pay stubs from the sponsor?

Hello,

My husband now makes enough money. We did another affidavit for this year.

We will also submit our taxes and his employment letter and paystubs.

Do I need to submit a new affidavit from the sponsor?

His 2005 taxes?

His paystubs?

Our sponsor's situation hasn't changed - still employed at the same company, etc.

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Technically you should not have to but as you work the I864 it might show up being short since its based on 2005 income. To be safe, take a fresh I864 from the sponsor in my opinion. You can explain your income meeting the requirements and ask to withdraw the I864 from the sponsor at the interview time (worth a shot and it will help ease the sponsor's mind also.) Good Luck

They did not look at any financial information at Luvy's AOS interview. I brought updated pay stubs and tax information but they didi not ask for it.

Are you saying that you had another sponsor because when you filed your AOS your husband did not make enough money? And are you saying that you have not had your interview yet?

If the answer is yes to both, and your husband can get an employer letter from his new job and can show his income, I would definately have your husband complete an I-864 with that information.

As motu said above, that would take your original sponsor off the hook.

I know that our adjudicator threw out our co-sponsor's affidavit at our interview. What I don't know is if the decision of sponsorship rests solely with the interviewing adjudicator, or if that decision is made somewhere else. It APPEARED to me that it rests with the interviewing officer. In other words, I think they can probably accept your husband's affidavit at interview and 'pitch' the original sponsor.

If for some reason they don't do that, the approval of your original sponsor SHOULD be adjudicated on the information already sent in.

I think the decision is yours - you probably won't need the updated info on your original sponsor (mostly because I think they will be very happy to substitute your husband's affidavit) but personally I would prepare it just in case.

Yes, since he has already signed the forms, etc and our sponsor's situation hasn't changed maybe I'll just ask him for his taxes and won't ask to sign the form again.

My husband's job situation has changed so we have a new affidavit, paystubs nd taxes for him.

Any opinions?
