Hi

My wife got her Green Card a year ago and have been going back home for the winter for the past two years, she hates the cold everything here.

She is leaving at the end of this month, I would like to start the divorce paper and if there is anything she needs to file we would like to do it while she is.

What can we do if there is any while she still here? no kids, no asset. We are very good term she just want to go home and stay there, how can get divorce. She has destroy her green card to show me she does not want to come.

Please help, we leave in New York.

Not sure why you'd give information for the State of NY but divorce laws vary widely by State. This is a divorce question. Google "divorce in (state)".

Easy: just file for the divorce and she would not fight it (answer to your allegations) and therefore you win the divorce by default.

Doesnt cost much either (around $400) because there will be no lawyers involved.

You can find the forms that you can file:

Your case seems to be uncontested divorce.

Choose one of the grounds there. You could ask an atturney to, but if you dont have anything to split and she agrees with the divorce you can do it yourself. It will save you some money.

Wierd that she distroyed her GC ... I have a GC and if I distroy it, I might have problems even exiting the country (since the visa in passport is long expired). She seems to be impulsive/fullish.
