We sent the package for the I-130 2weeks ago and we saw that they allready cashed the check.The only proof that we put in the package was a joint bank account and the copy of our marriage certificate(we got married in the USA).We didn't know that we could've sent pictures and emails and phone bills. :(

Is that enough?And if not,will they send us a RFE for that?What should we do?Shoul we send more proof in the I-129F package?

USCIS is only concerned with marriage evidence in cases where a couple ave been married and living together for some time before filing the I-130, if short time, then an affidavit from a friend or relative is enough.

Are you still in the USA, and was your intent on entry was to marry?

If you are still in the USA and immigrations was NOT your intent, why not file I-485 withe I-130 NOA1 instead of I-129F, and simply adjust status?

If you are not in the USA then compare timelines, and seriously consider the CR-1 visa, in most cases it only takes a little bit longer to get, and has the big benefit of NOT having to adjust status.

CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I an stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

I am not in the USA anymore...

We met last year in the USA while I was on a work and Travel programe....I didn't know that he wanted to propose this year...we got married on the 5th of Sept but I had to come back to Romania because I have one more year of med-school and I graduate.That is why we decided to apply for the K3 visa...We are going to get married here next summer too,with my family and friends in Romania.

Do you think that we should've sent more proof of our marriage?What should we do now?

A marriage certificate and joint bank account are sufficient. I too would recommend skipping the I-129F and just taking the CR1 route.

If you want to go the k3 route, you only need to include the marriage certificate and copies of prior divorce decrees. You may be given an opportunity to provide extra evidence at the interview. My wife's k3 interview didn't require any additional evidence (although we had plenty). It could have been that I was physically present at the embassy during her interview (I even went into the interview room so that the CO would see me before asking me to leave), or that her saying that I had visited 8 times was simply all they needed to hear.

We don't know what should we do because we don't know anything about the CR1 visa....we thought the K3 visa was the best option for us, giving the fact that we have to stay separated for almost a year because of my school.

Can somebody tell us what is the difference between the K3 and the CR1?Can we apply for both in the same time?Or which one is better for our situation?We are very confused.... :crying:
