Hello VJ- members,

I have 2 questions and would appreciate if someone could help and give me some info. I and my wife are filling out I-485 and we are facing 2 problems.

First question or problem is following :" A copy of the intending immigrant's birth certificate and/or passport along with English translation. (If in any language other than English)", Because we do not have her birth certificate here in USA , is passport enough or we have to submit copy of BC and passport ??

Second question is about vaccination supplement (I-693A), my wife had her medical and vaccination overseas but she did not receive I-693 or I-693A ,the paperwork that she has is DS-3024,DS-3025,DS-3026, now I am wondering what we need to do. Is DS-3025 enough because on this one it talks about her vaccination or we need to find doctor to do I-693A ?? And she has a vaccination card as well where it states which one she received.

12/09/05= I mailed I-129F by USPS ,registred mail

12/12/05= I129F received by USCIS /Vermont SC

12/15/05= I received NOA1 by snail mail

02/10/06= Petition Touched ,finally something from USCIS

02/10/06= @ 5:00 PM ,just received e-mail from USCIS finally APPROVED ,

02/17/06= Received snail mail from VSC my petition approved

02/17/06= NVC Received

02/17/06= NVC Left

02/20/06= Consulate Received

03/06/06= US Embassy told her she can come 3/7/2006 for interview

03/07/06= Interview Date : VISA GRANTED & Will pick up VISA today

03/15/06= US Entry

05/11/06= Wedding

AOS/EAD

09/01/06= AOS/EAD mailed in to Chicago

09/05/06= USPS confirms delivery

09/12/06= NOA1 AOS & EAD arrives in mail

09/18/06= Received Biometrics appoint. letter

09/22/06= Biometrics appoint.

09/29/06= Received RFE in the mail..(BC not translated,even we had international (with English Vers.) BC

10/19/06= Email form USCIS: RFE Response received

11/01/06= Email form USCIS: Case transferred to California SC !!!

11/10/06= Touched

11/21/06= Email from USCIS , AOS Approved

Did you not submit a birth certificate with your k1 visa application? I thought it was required? Or do you mean that she left it in her home country because that way someone can mail it to her? I sent my BC and passport in with mine because the guides stated so.

As for I-1693A, you get this once in the USA. You take her card she has from her medical overseas with her shot records on it and take that to a civil sugeon in the USA to transfer onto a I-693A. It can cost anywhere between 25-50 dollars and thats if she doesnt need any up to date shots.

I have no idea where your reference for "and/or" comes from but clearly on page 2/3 of the I-485 it states the following:

Initial Evidence.

You must file your application with the following evidence:

Submit a copy of your foreign birth certificate or otherrecord of your birth that meets the provisions ofsecondary evidence found in Title 8, Code of FederalRegulations (CFR), 103.2(B)(2).

Copy of passport page with nonimmigrant visa.

If you have obtained a nonimmigrant visa(s) from anAmerican embassy or consulate abroad within the last year,submit a photocopy(ies) of the page(s) of your passportcontaining the visa(s).

You must submit both.

If your existing K1 medical exam was done within the last year, then you don't need another medical. Pay close attention to I-485 instructions. It sounds like you got side tracked on something else.

Additionally, from the way I understand it, (done in practice with the uscis), if your vaccinations/medical is out of date, and they want it, they'll rfe you for it.

This medical/vaccination thing always seems to be the one thing that's a wild card for everyone. Not needed, needed, required/not, rfe, or bring it with you to the interview. There seems to be a million different results with the medical thing regardless of what the law/forms dictate.

I personally would just send both, to be on the safe side, thats what I did. Here is the civil surgeon locator: http://www.uscis.gov/graphics/exec/cs/index.asp

Some people have succeeded in not getting an RFE when sending in the DS-3025, some not so lucky. It's been rumored that if your shots are all up to date on the DS-3025 there may be no problems, but again, in my opinion, better to be safe than sorry....

I have read the guides before assembling and sending off my package. I was merely stating that I would send both to be safe because to me, it appears what the guides suggest to do. :yes:

Repeating/rewriting USCIS instructions and representing them as somewhat authoritative without legal review or at least putting in the appropriate caveats is somewhat dangerous imo.

That statement:

FWIW, I agree that #7 reads incorrectly. According to the instructionso n I-485, K-1 visa holders should include a copy of the immigrant's birth certificate AND a copy of the visa from their passport.

I fwd'd the correction request to Ewok and asked that the Guide be updated.
