:unsure: I recently married my wife who is an American citizen. I have a son, 11 years old, who is living in Venezuela with his mother. My American wife and I would like to bring my son to live in the United States. We have permission from his mother. Does my wife have to legally adopt my son even though I am his natural father? What we are trying to do are two things at once. Get my son and myself permanent residence here in the United States at the same time. But I already live here and he doesn't. Would we have to fill out special forms aside from I-130 for him. I already know the forms that I need for myself. We would like to know which forms we need for him specifically. Thank you for any help you are able to give us.

your son doesn't have to be legally adopted by your american wife... your wife can petition your son as her stepson since the marriage took palce before your son is 18... as to how it's done, i don't really know... search the forum about petitioning stepson, i know others have done it before...

All your wife needs to do is file an I-130 for step child since the marriage took place before age 18.

You will need evidence or relationship, child's birth Cert with your name listed on it, and evidence that mother is willing to give up custody, usually a letter from mother stating this.

9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png
