There seems to be lot of arguing between 2 people who basically agree on the same thing, K-1 visa holders are eligible to obtain a social security number.

I was stating that the local SSA office was incorrect in refusing to give the SSN number when the I-94 was valid and not about to expire in 2 weeks to the OP, though it has happened many times in the past and the couples / SSA had to educate a local office. I was also stating that K1's are eligible for SSN without EAD or AOS or green card, and you didnt need a work reason to get one as I Quit was referencing.

The SSA office was wrong in not accepting the application. You are not assigned an SSN or issued a card until SSA verifies your status with immigration. The 14 day period still applies even if you apply before that time and it passes while waiting for your status to be verified. It's possible to apply the first day you arrive and still not be assigned an SSN.

You don't need a "work reason" but you need what SSA considers to be work authorized status and has been verified to be assign an SSN and to be issued a card.

A little update to this thread. Sweety and I went to a SSA office and successfully applied for a SSN. No problems this time and no questions asked. How did we do it? I don't know. Was it because of a different office or different clerk? Maybe it was information that DHS sends to SSA?

All we presented to the clerk was Sweety's NSO Birth Certificate and passport. I specifically stated, "...SSN for my wife...", but the clerk filled everything out with my wife's maiden name.

In any case, we are waiting for her SSN card.

All we presented to the clerk was Sweety's NSO Birth Certificate and passport. I specifically stated, "...SSN for my wife...", but the clerk filled everything out with my wife's maiden name.

Unless the person looked at her I-94 they screwed up, since her K-1 status is the basis of her eligibility. If the SSN card does come right away and her status hasn't expired or within 14 days of expiring, I would head back for the name change. However, no matter what they say DO NOT DO NOT give up her SSN card until she receives the new one.

Maybe I should start a new thread, but I'll try here since this is related. We have a friend who entered on a K-1. Before the end of her 90 days, she married her fiance. Unfortunately, they never got her a SSN during the 90 day period (under the belief that she was not eligible). They have since filed for EAD and AOS (which got delayed because the husband did not provide the proper tax information with the AOS filing). So, she continues to wait to get her EAD (and her AOS).

She really wants to work and, of course, needs an SSN. Obviously, her K-1 visa and I-94 have expired. However, she was a K-1 visa holder, she did get married within the 90 day period and she did file for AOS and EAD (with proof of filing received). Is it possible for her to get a SSN under these circumstances (without the EAD)? Anyone had such an experience?

Apparently, they went to the SS office and were told that since her K-1 had expired, they needed to get an extension before they could apply for a SSN. I imagine they suspect she is an illegal immigrant who has overstayed her visa. I personally have never heard of an extension of a K-1....and give her marriage, it's obviously not necessarily even if it was possible.

My wife came here on a K-3, so I don't know much about the K-1 and the related issues, but we're trying to help our friend. Any insight on this situation? Does she have the ability to get a SSN now (she wants to work)? Or is she out of luck until she gets EAD?

1/26/07 - Adriana and daughter to arrive in Miami

I-485 and I-797:

2/12/07 - AOS and EAD sent to Chicago lockbox

5/7/07 - Employment Authorization card received

8/28/07 - Re-scheduled (from 6/28) AOS interview in Orlando - AOS approved.

9/13/07 - Wife and step-daughter receive green cards

I-751:

6/1/09 - I-751 mailed

11/18/09 - Removal of Conditions approved

Citizenship:

10/26/10 - Citizenship interview (successful)

10/29/10 - Citizenship ceremony and oath

No EAD card or I-551 stamp or card no work authorized SSN.
