Social Security Number

Yesterday Sweety and I went to the SS office and ATTEMPTED to get her a SS Number with no result. We were told that Sweety needs to get the EAD first and can then apply to get a number.

The clerk was very nice and polite and looked up many references on his side of the desk and even went to his supervisor without us asking and got the same result.

I recall reading on this forum and even the guide here that a number can be gotten but with the restriction of EMPLOYMENT PERMITTED ONLY WITH AUTHORIZATION. We were told that, that is not done anymore.

Sweety entered the USA on a K-1 and we presented the I-94 and even took our marriage liscence and certificate but still to no avail. Does anyone have any recent experiences getting a SS number under similar circumstances?

Hi, The person at the SSN office was incorrect. Call the National SSN office and complain you werent allowed to get the SSN card. they will call your local office and explain to them she is allowed to get it. However you need to wait 2 weeks upon arrival to USA in order for you wife to appear in the system. You can search on here , there are weblinks for the information that K1 are allowed to get SSN without work auth as long as the I-94 is valid and not expiring in 2 weeks.

I have not heard that its no longer allowed. I have seen many cases where the SSN people didnt know what the rules where. there are many threads on here for this happening.

You can try to take this paper back to the clerk who has no clue and his supervisor, but i would call the national office 1-800-772-1213, dont use the automated system, speak to a rep and they will call your local office. then go back to your local office. getting the SSN now will cut out alot of headaches of adding your wife to accounts etc before you have a green card and EAD.

We were told the same thing as you. We had to wait for the EAD to get her Social Security Card. The clerk got the same answer from her supervisor as well.

Then they're both incorrect. Besides, not everyone applies for EAD (it's not a requirement).

Hi there everyone,, i have a same situation as you,,but i have never been to any sss office because i know this is might gonna be the same answer,, so youre saying its ok to avail of the ssn even without a EAD and AP? , if they give us a ssn and could probably have a word" not valid for work", so what we will do next time to have another ssn with out this " not valid for work" ,do we need to go back and show the sss together with the EAD,AOS ? ,,how about if a have a daughter she needs a ssn too ,she dont need EAD, what does she need to show? .PLS! IM ME , I am really bothered !!! thanks !!!

they are suppose to give you a SSN card because some state require a SSN number to get a marrigae license. I know the state and county I love in have the following requirements

To obtain a marriage license in Shelby County, both parties must appear for the issuance of the license. A Social Security card is required for both parties. The age requirement for marriage in the State of Tennessee is as follows:

• From 18 to 21, a birth certificate

• From 16 to 18, you must have both parents accompany

  you, and sign the approval affidavit and you must bring

  your birth certificate. There is a 3-day waiting period.

• If either party is under the age of 16,a waiver must be

  issued from Juvenile Court.

That is why the social security office is suppose to get you a SSN and card if you show a current I 94. The sad problem is that most workers at the Social Seruity Office dont seem to know there own rules, including supervisors. But with that said good luck to you and call the number listed above so they can get this situation corrected for you.

We had the exact same problem! Had to go back the second time armed with evidence and were approved. Although when we finally got a letter from the SSA, they rejected us becuase hubby's I-94 was about to expire. Absolutely rediculous, of course, but at least we proved that we were eligible!

Print off this thread as well as the internal memo and bring is back ASAP!! Don't leave untiul they give you what you came for!!!

Which SSA office told you this? As long as the I-94 is not within 14 days of expiring, you don't need an EAD card to apply for an SSN as a K-1 and getting married doesn't affect this.

ROTFLMAO You would be lucky to find a 800 number rep that know a K-1 from a K-9 and if the field office doesn't have a clue the 800 number sure isn't going to over rule the office manager.

If you apply as a K-1 is should have "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" printed on it. Once your have an I-551 stamp or card you can apply for an unrestricted card. If you child has K-2 status she needs an EAD card or I-551 stamp or card to be assigned a work authorized SSN. Since it does not make sense to get an EAD card for a child unless you are going to have her make clothes for Wal*Mart, wait until the AOS is approved and she has an I-551 stamp or card. In the meantime apply for an ITIN from the IRS if she needs a number when you file your taxes.

SSA isn't supposed to give you an SSN. You either provide proof of work authorized status or a valid non work reason for needing an SSN and going married isn't a valid reason.
