I received a Rejection Notice. My Wife came to the united states on a K1 Visa therefore i had filed I-129. After she arrived and we got married within 90 day I called uscis to find out what i needed to file next and they told me to file I-130 which i did. I called USCIS to check the states and was informed i didnt not need to file I-130 (filing fee $355 which i lost) since my wife was already here in the united states on a K1 Visa, also we are married now. I was told to file I485 I-864 and G325A. I mailed them I-485 I-864 and G325A and they rejected my application. They stated the following reasons.

Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

The following documents may be provided.

Your original form I-130, (petition for alien relative) if you are filing concurrently, or

Your original form I-360, (petition for ameriasian, window(er), or speical immigrant) if you are filing concurrently, or

Your original form I-797, (notice of action) if the petition has already been filed/approved; or

Other evidence that an immigration visa petition has been filed/approved on your behalf

In my packet i included the following.

I-485

Copy of passport

Copy of K1 Visa and entry stamp(i-94)

Copy of Approval Notice for I-129F

Copy of I-797, Notice of Action (for I-129)

Copy of Marriage License

Copy of Birth Certificate

G-325A,

2 2X2 Photos

I-864, Affidavit of Support

Three Years U.S tax Form

Check for 930.00 (I-485 Fee) and 80.00 (for G-325A)

Since i did receive a Notice of Action for I-130 even though i did not need to file it, do i need to submit that as well with my packet?? Please Help

Have you mentioned in your I-485 application that you have files for I-130? If you did, then that is the reason they want to have your information on that. Next time you file your application, make sure you don't mention your wife'sI-130 application. Appearantly they don't have it in their system. If you do need to file for I-130, for the reason your wife is in US for more than 90 days, then you should file afterall.

What happened to your I-130 application? Has it been cancelled?
