Hi guys.

Just arrived in the last fourteen days and trying to plan out our wedding and then the next bureaucratic step on this crazy rollercoaster ride. Once we're married we of course wish to proceed with the Adjustment of Status and Employment Authorisation as soon as possible. According to the costs for filing it is 1010 dollars for the Adjustment (and biometrics) and 340 dollars for the EAD, but if you're filing both at the same time you only have to pay the 1010 dollars. Is this correct?

Any information would be greatly received.

Yes the cost of applying for AOS and EAD and AP is $1010.00.

08-30-2008 AOS Required doc sent to laywer via USPS /c Certified Mail

09-04-2008 Lawyer sent application to DHS (Woo!)

09-15-2008 Biometric appointment scheduled on 10/06/2008

10-06-2008 Biometric done!

11-07-2008 NOA for interview. AOS interview set Dec 9 2008

11-17-2008 EAD production ordered. Travel Doc approved

11-22-2008 Got APin mail

11-24-2008 EAD in mail!

11-24-2008 AOS interview prep and verification of evidence of shared life with my lawyer. Laywer gave me "the most documented marriadge of year award"

12-09-2008 AOS interview @ USCIS Seattle Office. IO thought I had way too much evidence for the time I've been married. Oh Dear.

Looks like you paid too much...I see that you filed w/ a lawyer...was there a lawyer fee involved, which could account for the extra $. If not, then you may want to look into which of your checks were cashed. The AOS fee (w/ biometrics included) is $1010. The payment also covers the ancillary applications of EAD & AP, and it is your choice to apply for them or not.

Only cost is $1010, EAD based on a pending I-485 costs nothing.

Include I-765 with your I-485 filing, and code the I-765 (C )(9 ) Based on pending I-485, NOT (a )(6 ) Based on k-1

You MAY want to read the directions included with I-485 Instruction Page 7, OR I-765 instructions Page 8

If you were using a lawyer, I would be demanding a refund, they SHOULD KNOW THIS, the fee structure changed over a year ago July 30 2007

I don't know what you mean by which check were cashed. Lawyer asked me to write a check for $1350 so I went to BOA and got casher's check and addressed that to DHS. No multiple checks were invovled here.

How did you enter the USA? Was it a K-Visa??

If K-Visa the fee to adjust is $1010

If by another visa then fee should be $1010 for I-485 and $355 for the required I-130 which is $1365.

I just checked the USCIS website and the fee for the I-485 form is 985.00 and the biometrics fee is 85.00 bringing the grand total to 1070.00................no extra fee for work (I-765) or travel (I-131) application if applied for at the same time.

I-485, Application to Register Permanent Residence or Adjust Status

Filing Fee :$985. (Add $85 biometric fee for a total of $1070, where applicable. See the form instructions for payment details.) You must make your check payable to Department of Homeland Security. (copied directly from the USCIS site ) :)I am the US citizen getting started on the paperwork for my hubby, I'm in Pennsylvania, USA, not exactly sure what the "where applicable" part means so I'll send it to be safe :)
