nervous about AOS interview...HELP

Ok, i will try to condense my situation and give all the important info at the same time...

my husband and i met in Mexico in Nov. 2005. he got a tourist visa and visited several times. 1st time for a week, then 3 months, then 2 months then 6 months. I visited too. he proposed in feb of 2007 and we got married (religious ceremony) in Mexico on Nov 24, 2007. we came back in early december (with his tourist visa) and got married legally here dec 26, 2007. he's been here ever since and we applied for AOS in July. We waited so long because we had to save up the money for the application. We just got the notice for the interview and after reading many blogs and web sites, i'm totally freaked out that they will question his intentions when he entered in december! i don't know what we should say. I've heard that it would be bad to mention our religious ceremony (even though that's what was most important to us vs. the 30 second ceremony in the waiting room of a chapel in Reno,NV). We have plenty of pictures and emails confirming our relationship. we're both on the lease of our apartment and have a joint bank account. The only thing i'm worried about is that there will be problems if they don't believe that he didn't have intentions of staying. It's really funny too because when we came back together in December, i was apparently stupid when going through immigration/customs with him and when they asked his reason for travel, we said that we had just gotten married and were going to apply for his residency. The officer didn't even blink an eye, stamped his I-94 and sent us on our way. later i was told that was the stupidest thing i could have said! i guess we were lucky.

anyway, i need some advise in preparing for the interview. Has anyone else been through a similar situation??

Hikes,

This is going to be tricky because according to USCIS policy, if you enter the US with intentions to get married (and actually you were already married back in Mexico), and you entered with a visa other than the fiance's or foreign spouse's visas, it could be considered visa fraud. By visa fraud, I'm not saying that they will doubt your relationship is truthful but they will give you a hard time since there is a reason for the existance of a fiance's visa and many people are already in a process that sometimes takes twice as long. The only reason why they wouldn't blink an eyes would've been if he would've entered w/o intention. You mentioned that you told the truth and actually the truth could've put you in hot water and the immigration officer could've easily denied his entry and sent him back to Mexico.

Here in this forum we cannot give you other kind of advice but to tell the truth, the truth here is that you didn't research the immigration process before getting married and entering the US with the intention to overstay his tourist visa. It is harsh, I know, but bottomline, it's the truth.

I would advice to go and talk with an attorney, or even to hire him/her to come along with you guys to the interview, if you pay for a good one, those guys can work their magic, you are in a tricky situation and it would be better to be safe than sorry. I'm the foreign spouse here, I know the process is somewhat stressfull but since this process is the starting point of your lives together, the least you could've done is to look at the guidelines before getting married.

Good luck to the both of you
