my sponser will use her Assets only and its car and house i think they both like 40.000$ and there's a van and house by loan and she paying the loan for both of them from 2 years can she use this house and van to support her and how she can use it? beside her 8 years old daughter geting a cheek from social securety like 800$ a month thats enough for her to be my sponsor?

The assets and income needed require the Sponsor to have assets to support a family of 4. That includes the sponsor you, your spouse, and the daughter of the sponsor. 125% of the poverty line the sponsor needs to meet is $26,500 annually.

In that case she needs three times as many dollars worth of equity (assets minus and loan or mortgage balances) to qualify. This is a technical minimum, not an assurance. The standard you need to meet is to convince a Consular Officer, you won't become a public charge. It's unlikely an intelligent person is going to believe your fiancee is willing to sell her house and car to pay rent someplace in order to support you. If her only income is child support of $800, and only assets are tied up in house and car, I would not expect success.

You'll probably need a co-sponsor or she'll need a job.

It's not false but it has to be done in a way that actually works. You described a way that sounds like it won't work.

Good luck. If you don't give them enough details, you won't get much of an answer. Frankly other than to confirm that assets can be used, I doubt they'll give you an answer until they see the affidavit.

They may do some things we don't think are smart but they would be complete idiots to consider only assets tied up in a home you live in and a car you drive every day as reason to conclude an intending immigrant will not become a public charge. They would have to expect your fiancee would sell her house and car to pay for shelter and food. With no job and only $800 a month in income for a family of three, you'll need a qualified sponsor or your fiancee will need a job.

Ok, but you haven't been clear about the whole picture.

Take the car she drives and the house she lives in out of the picture and tell me what's left.

How much is each asset worth and how much is the loan or mortgage against it? Then we have something meaningful to work on. Does she also receive rental income from the second house?

There is a home that still has some mortage left on it that was being rented out but is not now. The property it is on is debt free as well as an acre in another county. The household currently being lived in is only 2 to 3 years into the mortgage. There is a car that is paid for as well as another used every day.

She is getting a widows benefit for herself and child which she knows will end after marriage. However, the childs will continue.

So of what is left is the childs benefit which wil continue , one car , one acre of land, one parcel of land and a small mutual fund. She is only working very part time and is looking for ful time enployment.

These assets have not been offically valued yet and she was not sure if only an appraiser could make the judgement of the value and if they can do a vehicle as well as porperty or homes.

The items left with an outstanding balance i think can be counted if they value of htem is taken from the balance owed. Which could stil yield some benefit by claiming them

The homes will need to be appraised but any car dealer can give an appraisal of the paid for car.

It sounds like the bulk of any actuall equity is the paid for house and land. How much does she think they are worth.

How much is the total income that will continue, including the income from employment?

If you'll answer the specific questions, I can give you an opinion on where you stand.

The latest Property Tax records/bill will give a very good (and acceptable) valuation of the home/property.

If that doesn't seem appropriate - any qualified Realtor will do a valuation of the property for free. If they want money - get a different Realtor.

You don't really need to have the home/property appraised (by an appraiser) - one or both of the above will be fine - no sense paying money (which an appraisal will cost). :thumbs:

The homes will need to be appraised but any car dealer can give an appraisal of the paid for car.
To be perfectly candid - if it were me/us, I wouldn't bother with the car/van (while it may have value, it's not considered with the same weight as a fixed asset). :thumbs:
