filing I-751 concurrently evidence of eligibility..please help

I'm trying to finish all the paperwork and send it but I really need help.I'm concurrently filing I-130,I-485,I-131 and I-751.For I-751 do i need to attach the whole exact copy of the package of I-485 with all the supporting documents pics and everything or just the form or cuz they are all going to the same place do I need not to attach the I-485 at all????

Huh??? :blink: You are filing I-130/I-485 concurrently with I-751 Removal of Conditions? You cannot do that.

You and your spouse first apply to adjust status (I-130/I-485) to become a permanent resident, and if on the date of the approval your marriage is less than 2 years old, then you will be approved conditionally and will receive a 2 year permanent resident green card. After two years you then apply to remove the conditions on your permanent residence using the I-751. If approved, you will then receive the 10 year green card.

Do you by chance mean the I-765 (Employment Authorization)?

I-751 is removal of conditions and is filed within the 90 days prior to the 2yrGC expiry, not concurrent with I-485/I-130.

hahah yes I'm sorry employment authorization.my head is about to explode.

I'm sending them all in one package but I'm not quite sure if im suppose to attach copy of I-130 package to my I-485 and attach a copy of my I-485 to I-765..I called NVC and talked to 3 people.everytime I ask them a question they give my different answers.I really do want to send these papers on Monday.if you guys can clarify my question it will be really appreciated

About your question: no, you do not need to provide extra copies of the I-130 (for the AOS) and I-485 (for the EAD), one copy of each form will suffice. What you do need to make sure is that you provide multiple copies of the same document, if they are requested as evidence for multiple forms. For example, a copy of the alien's passport is asked for both the I-485 and the I-765. In other words, make sure that each application can stand on its own, with its own set of evidence, as they are separated along the way and different people look at them.

The way I organized my package was into two folders (both stuffed into a big envelope):

Folder 1: I-130 and evidence, G-325A for alien and USC.

Folder 2: I-485 and evidence, I-765 and evidence, I-131 and evidence, I-864 and evidence, medical, G-325 for alien.

Would you have joint tax returns too? If not, don't worry, you have enough joint documents.

• Form G-325A – Biographical data Here you don't seem to have the two attachment sheets, what are they BTW?

• I-864 –Affidavit of Support completed by my husband his name

In both cases of the Affidavit of Support (petitioner and joint sponsor), it would help to provide recent paystubs, 6 months, if you have them. Also for the joint sponsor, a letter of employment

I don't think you have too many documents, my only comment would be related to the documents attached to the I-765 and I-131 applications: I only submitted copies of my passport bio page and photos, so I'm not sure if you need the other things (birth certificate, last I-20, passport page with non-immigrant visa, I-94, waiver that was granted at the port of entry, marriage certificate). I know for sure all these are required for the I-485 (BTW, I did not notice the copy of the F1 visa as part of the I-485 evidence), but I'm not sure if they're needed for the EAD and AP. Check the form instructions again, I would hate to mislead you.

I don't think I need all those papers for the I-765 and I-131 I put them cuz I saw everybody else did:)but I read somewhere for F1 I have to show my status and this is shown by last I-20 and I-94.so since I entered here with visa waiver (stupid me didn't realize my visa expired until i got off the plane but they let me go with a waiver of visa document)that says on my I-94 so i thought i might as well attach it before they ask for it.my f1 visa is on the passport pages i provided so i didnt put it on the cover letter but i will make a seperate note for it you're right its not explanatory. i think i might take out some of that extra papers off my other 2 forms.we dont have joint tax return since its been only 2 months we are married. my joint soponsor is self employed he is a doctor(he owns the business) so he gave me only tax returns i hope that doesn't create problem.But i really appreciate your help..hopefully this week i will be done with this thing.it is very stressful

and the 2 attachment forms for g-325 are jsut seperate sheet of paper cuz I couldnt fit it in the form for the residency and the last address i lived abroad was too long address so i put it on another sheet of paper

Thank you again!do you think I just put little paper clips to seperate the forms like my I -20's, to hold them together, or pages of my passport or should I just put one binder clip to I-130 and then another one for I-485?

Yes, paper clips to separate the forms and other documents are good. Don't use staples, they don't like that. Paper clip each form (I-130 etc), paper clip the passport pages together, paper clip the birth certificate and the accompanying translation, the I-20's together etc. Then you can use a big binder clip to hold together the I-130 and another for the I-485, or use two paper file folders instead.

Don't worry about it, I can definitely relate :yes: You can put the passport pics either in an envelope or in a transparent ziplock bag, which you then paper clip to the G-325A or the form itself, shouldn't matter. Paper clip the check to the relevant form too.

Don't forget to write your names on the back of pics either in pencil or sharpie.
