Hi Everyone,

question; My husband has recently received his EAD card. This morning he went to the dmv to get his Kentucky drivers licence. He has been driving on his canadian drivers licence since he has been here. He also has a cdl with his canadian license.

The people at the dmv told him that if he went ahead and opted to get his license this morning, he would lose his cdl (commercial drivers license). They advised him to wait until he received his green card and then come back to get his kentucky drivers license because they could then just transfer his cdl over.

They basically were saying that a person has to either be a citizen or a permanent resident in order to carry a cdl.

Has anyone ever heard of this?

My husband does not want to lose his cdl and is wanting to wait for the green card before he applies for a kentucky drivers license? Does anyone advise this? Does he have a certain amount of time to attain a kentucky drvers license? Or can he at any point go get one, now that he has the EAD? i KNOW THE ead s a good for a year, would he have up to a year to get one?

Any advise/thought would be greatly appreciated.

Thanks!

They basically were saying that a person has to either be a citizen or a permanent resident in order to carry a cdl.

That makes no sense. An EAD is an interim benefit meaning that a GC is on the horizon. Also, you are able to work, so if you had a job that required a CDL, you'd be screwed. This may be a case of the DMV employee just being clueless, or having some kind of a powertrip. Look at the DMV website and see if there's anything in writing one way or another about the CDL.
