does anyone know if we have to fill for AOS within 90 days of entry? what happens if it goes pass the 90 days?

02/01/05: Sent I129F

02/05/05: <!--WORD2URL-01--><!--END WORD2URL-01-->USCIS<!--WORD2URL-02--><!--END WORD2URL-02--> received I129F

02/11/05: Recieved 1NOA

03/16/05: Approved 2NOA

05/02/05: E-mailed US Consulate HCMC

05/03/05: Got HCM number through phone at U.S. Department of State Visa Office

05/06/05: Recieved e-mail Package 3 was sent today

05/19/05: Package 3 recieved

05/24/05: Turned in DS230 at US Consulate HCMC

09/07/05: Failed Interview, got blue slip requesting additional evidence and credit card statements

10/11/05: turned in requested documents and got approved

10/27/05: arrived in US

02/10/06: turned in I485/I765

08/24/06: I485 approved

09/06/06: got Permanent Residence Card in mail

08/06/08: sent i751 removal of conditional basis

04/25/09: received approval letter from USCIS

Technically / Legally you need to file for AOS within the 90-day time period. You are "out of status" otherwise.

Many people have filed post-90 days without any repercussions!

Good luck but I would make every effort to stay within the legal time frame!

11-26-07 I-751 Petition Transferred to CSC and Check Cashed

12-01-07 NOA For 1-Year Extention RECEIVED from CSC

12-17-07 Biometrics Letter Received / Scheduled for 1/8/08

01-08-08 Biometrics Completed At ASC

01-08-08 Touched

01-09-08 Touched

03-26-08 10-Year GC APPROVED!!!! HOORAY!!!

04-03-08 10-Year GC ARRIVES! GC Journey Over For Another 10-Years~On To Citizenship

N-400 Application

10-15-2009 Application Filed

10-16-2009 Application Received / Lewisville, TX

10-21-2009 NOA I-797 Receipt for Application

11-10-2009 Electronic Notice of RFE For Biometrics

11-12-2009 Biometrics Letter Received

There are advantages of filing sooner than later, like getting EAD faster.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

There has been several posts of people filing past the 90 days with no problems. Don't let it go too long. Good luck
