Timeline

I NEED YOUR HELP!

HERE ARE THE FACTS OF THE CASE:

1.) A FRIEND OF MINE ARRIVED HERE IN THE US IN 2002 AS AN IMMIGRANT, EMPLOYEMENT BASED.

2.) SHE GOT MARRIED 2005 IN THE PHILIPIINES.

3.) SHE FILLED I-130 FOR HER HUSBAND WHILE SHE WAS AN IMMIGRANT IN 2006.

4.) SHE GOT HER US CITIZENSHIP THIS YEAR 2008. OPTED TO GO TO A K3 VISA ROUTE SINCE AS ADVISED BY A LAWYER AS A MUCH FASTER ROUTE.

5.) K3 VISA PENDING AT THIS TIME. I-129 F FILED JULY 2008 APPROVED BUT I-130 FILED ON 2006 NOT APPROVED YET.

HER QUESTIONS AND CONCERNS:

1.) WHAT WILL ARE HER OPTIONS? CALL USCIS TO REQUEST TO EXPEDITE I-130 PETITION OR CONTINUE WITH K3 ROUTE?

2.) IF THE K3 VISA IS APPROVED AND HOPEFULLY ALL GOES WELL VISA IS GRANTED AND HER HUSBAND COMES HERE IN THE US ON K3 VISA, WHAT WILL SHE DO NEXT? CAN SHE FILE FOR AOS (ADJUSTMENT OF STATUS) FOR HER HUSBAND EVEN I-130 IS NOT APPROVED YET? OR NOT?

3.) DOES SHE NEED STILL THE ASSISTANCE OF A LAWYER ON THIS CASE?

Mikko this is just my own opinion basing with the experienced of my friend who is in the US now but hoping some of our friends here will share their knowledge about it.

1.) WHAT WILL ARE HER OPTIONS? CALL USCIS TO REQUEST TO EXPEDITE I-130 PETITION OR CONTINUE WITH K3 ROUTE?

Ans: if she's willing to wait within the period of time then she can call the USCIS to expedite her Cr1/I-130 application but if she is willing to contenue her k3 route she need also to call the USCIS to cancell her Cr1/I-130 application.

2.) IF THE K3 VISA IS APPROVED AND HOPEFULLY ALL GOES WELL VISA IS GRANTED AND HER HUSBAND COMES HERE IN THE US ON K3 VISA, WHAT WILL SHE DO NEXT? CAN SHE FILE FOR AOS (ADJUSTMENT OF STATUS) FOR HER HUSBAND EVEN I-130 IS NOT APPROVED YET? OR NOT?

Ans:Yes she can file for AOS/adjustment of status her Cr1/I-130 has nothing to do with her AOS filing when her husband come under K3 Visa she should really file AOS otherwise the Us govt will not aknowledge their marriaged.

3.) DOES SHE NEED STILL THE ASSISTANCE OF A LAWYER ON THIS CASE?

Ans: In my own opinion that is just wasting of money she can sign up here and she can ask some info we have so many knowlegeable members here in vj Infact if we only found these site early maybe we never pay for a lawyer anyway we spent so much for a lawyer but then were not satisfied with his service

05-06-2008 : NVC Received :

2008-07-01 : Case Completed at NVC

2008-08-05 : NVC Left

USEM

08-25-2008 : Consulate Received

08-20-2008 : Medical Appointment Date

09-04-2008 : Interview Date

STATUS

08-27-2008 : Medical Passed

09-04-2008 : Passed (Pink and White slip) additional documents and Dv

10-17-2008 : visa on hand

DEPARTURE

10-25-2008 : US Entry

Minneapolis : Port of entry

Kansas City, Missouri : Final destination
