Our I-129F was approved on Sept-9-2008. :dance:

My fiance called the NVC this last Tuesday (Sept 30) and they said they haven't recieved our case yet. According to the Flowchart it should be there by now or on it's way to the Embassy.

Should I be worried? :(

What should we do? :o

What worries me is that I have until January 8 to go to my interview according to the NOA2 he recieved. And with the Holidays coming they probably will be closed for a few weeks so that shortens my timeline.

American business and government do not shutdown for any length of time during the holidays. A typical business will have about 7 paid days off during the year, most of them are bunched up into the last 3 months of the year, but either way, I'm sure the embassies are fully staffed almost the entire year as well, with only a day or maybe two off for major holidays (even christmas is usually just one day... thanksgiving is often two days).

As far as running out of time before your interview, that's pretty unlikely, and from what I've read it's likely to be extended if the interview can't be scheduled during that time because of the processing times... either way it'd take a HUGE delay to not have an interview date setup by then.

CSC has a history of sometimes taking it's time getting approved petitions to NVC. There seems to be this period of limbo where neither office will say they have your petition. If you do a search on here you will find others who have been in similar situations. There have also been circumstances where CSC has made an error and filed the petition instead of sending it off. Whatever the case, you will need to be pro-active on your own behalf. Keep calling USCIS until you have an answer as to where your petition is. It's true, we call it the misinformation line, but eventually you may just be able to talk to someone that has a clue. ;)

The 4 month validity date of the approved petition is routinely extended automatically when the Consulate is unable to make the interview date in time. You will want to be sure to confirm this with the Consulate.
