Is there an official list of reasons that a K1 visa could be denied LEGALLY? I know there is alot of speculation and conjecture on this website but what are the LEGAL reasons for denial?

And now a question: I am the American (I am female), my fiancee (obviously a male) has no job, job skills, or educational background. (He is only 21 years old). I make enough money to support the financial requirements but can his lack of job, etc be a reason to deny him a visa?

I don't have a list of denial reasons to give you so maybe someone can enlighten you on that.

However, in RE: to your other question:

I don't have any skills or college education. I had hardly any money to my name and I didn't have a job and I was approved. Also my husband didn't have a job at the time either so we had a joint sponsor help us. So no... those things won't be a reason for denial.

However, in RE: to your other question:

I know a lot of foreign women are in the position of no job, no money, etc but I am not sure how the USCIS will look upon a foreign MAN (gender being the issue) with no skills or job. I know gender SHOULDN'T be the issue, but often times it IS. I am also 14 years OLDER than he is, which was another thing I worried about.

It's not that simple. Sure, if you haven't met in person or aren't free to marry when you file, the petition will be denied. If your fiance(e) is a prostitute or you make a material misrepresentation, there will be no visa.

Totality of circumstances is considered.

If your fiance is an unskilled 21 year old and you're 40, you're going to have a difficult time convincing a CO the relationship is bona fide, but no, in and of itself having no skills or a job is of no importance. Unless the job would continue in the US, having one doesn't really help either, again, in and of itself.

Learn the process and everything you can about requirements and best practices, then do the best you can. If you have specific questions after studying the guides, we're here for you.

Actually, my point was that older American men frequently marry younger foreign women (including younger unskilled foreign women) I just want to know if this an issue the other way around?

One of the biggest red flags is American women taking money to marry foreign men but in my case, I am wealthy. Unfortunately, this doesn't absolve the red flag, it just creates a new one: Perhaps he is "using me for my money". Ok, fine, I see that point, but how can he PROVE he isn't?

Proof that you have met in the last 2 years is the biggest one, so pictures, airline tickets, hotel bills, passport stamps etc.

Personal emails and letters help, Chris and I have been mailing stuff back and to each other since November 2006, it doesnt matter if its simply a letter or a pacel, but remember to keep the packaging (for the dates) and then the letter or card to prove the whole sending things because you cant have a face to face convo.

If you use the internet for voice calls or instant msgsing, copy the call/conversation history (Chris and I gave them like 300 pages to troll through lol) if you are showing that you speak to them every day like you would if you lived together or were married.

Not sure if this helps, but I hope if gives you some ideas, otherwise there are some great guides floating around the forums you just have to look for em.

04-25-2007 Admitted that we had feelings for each other started talking on skype everyday!

10-12-2007 Met in US in person for the first time, love at first sight lol, 2 perfect months together.

07-17-2009 Court day 2: Success, must respond by 21st August. - No result ever came from this.

10/06/2009 Withdrew K1 petition

10/10/2009 Married

10/24/2009 CR1 packet completed and posted

10/26/2009 Packet arrived at Chicago - And Submitted our Aussie application

11/04/2009 Application of CR1 returned - was rejected because of a "blurry zip code" we didn't bother to re-apply given that Chris had lost his job

04/05/2010 Australian application still pending

September 2010 - Chris arrived in Australia on Temporary Visa.

10/10/2011 - 2 year wedding anniversary - Chris to be granted Australian Permanent Residency

Summer 2012 - Planned immigration to USA.

*We have visited each other 8 times since 2007*

Thanks, yes I sent in a mountain of proof. He emails me daily. We talk on the phone almost daily but I paid for the calling plan and with it, I have to call him, not him call me. Hard to know what he could do to prove he loves me from a world away other than talking to me by chat and phone and emailing. He emails me alot more than I email him, does that help? ;) hahaha too bad I couldn't just write, "well, if he don't love me he sure has a convincing act" signed naive stupid clueless American woman who couldn't tell if a man was BSing. :bonk:

Yes the reverse age difference is more of an issue than the more common. Again, the totality of circumstances are going to be considered and I can't comment on them comprehensively with regard to your case because there are too many unknowns. I will say that time together is always the best evidence of bona fides.

You don't "prove" any of this. You present evidence and he has an interview where he puts his best foot forward to go along with every fact in the file. Then subjective judgments are made by professionals. You've come to the right place to learn the process including how to prepare.

And simply because we met though his cousin I am in Visa hell. It is to the point where I wonder why I should go on. I haven't seen him in a year and am rapidly loosing my will to see tomorow

me too, this is terrible ... I am so sorry for you Sylvia and Joseph and I will pray for you both to be together soon. Maybe you can go be with him during this time and comfort each other until you get the visa? Can you take the time off work? God bless all the strong people on VJ, this is truly not an easy process but I think so worth it to earn true love.

It has a lot to do with the Consulate you will be going through for the visa. Higher fraud posts will scrutinize relationships with larger age differences more than others. If you are going through a higher fraud Consulate you will want to gather all of the proof of bonafide you can... leave nothing to question.

BIG HUGS TO YOU..I know how you feel. I have not seen my Kai in 1 year 5 months. If it was not for the webcams voice chat everyday. letters emails you name it I would go INSANE! There are a few days where I cry because I miss him so bad and he cries for the same reasons. YET we both know and God knows he will be here soon. This journey has been hell (waiting for the noa2 is the LONGEST WAIT!!!!)

Hold your head high sweet one and know GOD (or whoever you believe in) is watching over you and knows YOU both are deserving of this visa!

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

We don't have the luxury of internet connectivity. It is terrible , the separation and being so alone. I can't take time off work and my daughters huband walked out leaving her ( and me) with 4 young childern two of which have mental/behavioral issues. I have all the strikes against me, high fraud conulate , older woman younger man , different races. But all those reasons mean that I am being treated unfairly which is basically illegal. But knowing that the government is guilty of acting illegally doesn't help the days when you just want a hug or a kiss. Days like yesterday when my sons car broke , my grandson ran away from home and UPS has lost my passport on the way to the embassy ( to request a visa so I can visit Joseph ) The wedding dress has been moved so I don't see it in the closet anymore. I cancelled the camping trip and can't even go inside my camper without crying . We know we will be together as we will not give up. Thank for all your hugs. Sometimes I just can't stand what is going on.
