Timeline

I am a male UK citizen and will be visiting the USA soon and want to get married to a USA citizen within 3 months. We have known each other and lived together - for periods during the last 18 months.

I do not want to be a permanent resident as we plan to spend about 6 months in the USA and the same in the UK.

I have no intention of working in the USA and I have adiquate finance for living and traveling.

Would there be a problem about getting married - say after 2 months ? - there seems to be some mention of 61days in other letters.

If I got married and then returned to the UK within the 90 day visa waiver time, could I return to the USA without difficulty??

I can make a good case of not wanting to live permanently in the USA, as I have property, pensions and family in the UK.

It will be a gamble each time you want to go into the US after marrying. You would indeed need to prove ties to the UK and even with those they can deny you entry for being married to a USC. Does not sound like a feasible plan to me.

If you are not planning to settle in the US, it'll be a hassle but it's possible, just be prepared to show proof that shows your residence in the UK and indeed you are just coming here temporarily. ;)

It wouldn't matter when in the duration of your stay you got married, as getting married and then leaving within the terms of your visa/VWP is perfectly legal - the potential problem comes when people get married on the VWP and then file to adjust status, as it is visa fraud to enter on a non-immigrant visa/VWP with the intent to marry and stay. You are doing nothing wrong by marrying and then leaving before your visa expires, without attempting to work or overstaying - for those who change their minds and decide to stay after entering without immigration intent, it is obviously more plausible if they married late in their stay rather than immediately on arrival. Like the others said, your problem would be on entering the US married to a US citizen and proving you do not intend to stay, and when exactly you got married would be irrelevant. Also, the VWP only gives you 3 months and you said you intend to stay for 6 - were you intending to make multiple trips on the VWP or apply for some other kind of visa? I am wondering whether it would not just make your life simpler to get resident status, for example by marrying, leaving and then applying for a spousal visa while you are in the UK. YOu would probably have to cut down on the 6 months/year in the UK to keep our resident status, but after 3 years you can apply for citizenship and then come and go as you please. I am just thinking this as if you are a resident, you can get a social number and it makes things MUCH easier, for example for opening bank accounts, getting health insurance, a driving licence etc, which I guess you would need if you are spending 6 months/year here.
