Forgive me if this is in the wrong section......

I arrived here in December last year on a K-1 Visa and am currently awaiting my change of status. My ex-wife passed away and after some legal disputes I have finally been granted custody of my Daughter over my ex's boyfriend (long story, British law etc) She is currently staying with my Brother and Sister-in-Law who have temporary custody until I can arrange for her to come over here.

My questions are....

1. She is listed on my Visa but because she was staying in Britain she never came to the embassy with me as she was not moving across here, will she be able to be 'activated' on to my Visa or do we need to apply for her separately?

2. If we need to apply again can she come and stay here whilst we apply?

3. Is there any other way to get her over here quickly? My Brother has three children of his own and things are pretty cramped also she is getting more and more emotional at not being able to be with me.

Any help would be gratefully received

1) If it has been less than one year since getting K-1, daughter still can get K-2 FTJ, contact DOS or the Embassy about this. Dont let it get past a year, if that happens, then when you are green-card holder you could file an I-130, but the wait time for child of LPR can seem long.

2) Again check into K-2 FTJ may be able to get the visa and simly travel using the K-2
