This should answer the question once in for all. My fiancee took a copy of the document to the SSA. They said, "Yes, we know!" and gave me my SSN. That and a phone call to the DHS is all it took for me to be eligible for work in the US. Nuff said? :dance:

I've read that information. For a K-1 Visa, the I-94 expires 90 days after entry.

Ys, Roy and Yazi & Cassie are correct. The visa itself is used once you enter the US. Then you are on the I 94 time. That's it. Technically I believe you can work as long as your I94 is valid, a point which has been debated quite a bit here, but you don't have 6 months. You have 90 days from entry until it expires....

I got Married last Sept. 28, and today Oct. 2 is my last day of my 90 days, have already my SSN card but it was said "Allowed to Work with DHS authorization only" and i haven't file yet for AOS and I-765. But i'm planning to work in a part time job, could this be okay?

Sure you can. The 90 days apply only to your I-94 which means if you don't get married within 90 days, you would have to leave the country. But your visa is valid for six months. K-1 visa holder is allowed to work in the United States. Just take your passport with the I-94 and visa attached along with your SSN to your employer and have them call the work eligibility hotline (The DHS).

I started working two months after I arrived in the United States. We haven't started adjusting my status yet, but I applied for a job and I was hired. My employer called the DHS and verified all the information in my passport. And they hired me anyway. So you can work. But don't wait. Send in the I-765 and I-485 right away.

NOTE: K-1 is valid for 6 months or to whe it is USED whichever happens first, it is VOIDED when it is used, after that and the I-94 clock begins.

The validity date on visa has nothing to do with work authorization, all that date is for is when it MUST be used to enter the USA by, nothing else.

The K-1 Visa is no longer valid after 6 months for the purpose of entering the US. It cannot be used to reenter the United States. The status, however, remains as K-1 Visa holder change of status, until adjusted. The I-94 just says "K-1" and records the status and date of entry into the US. It is generally considered to be valid for one year, unless otherwise noted on the I-94.

Evidently, the DHS agrees with me, otherwise they never would have approved my EAD or given me my green card. They were aware of my work history. :bonk:

Ancient History? my wife also arrived in 2007. an expiration was on her I-94. here's an :idea: . maybe a poll could be started with recent K-1 Visa arrivals to see who has an expiration on their I-94.

Vacuum, wash clothes and dishes. Get husband's beer so he does have to get up from TV. Plenty of work to do. LOL
