If your fiancee has a drivers license from her own country, that should be ok for a year--most states will accept her international drivers license. I've also been looking up this information since my fiance and I plan to do a road trip after we get married.

I just applied for my DL here in NV, and was informed that it would expire when my I-94 expired and a letter saying my AOS application was received wouldn't be enough to keep my DL from expiring. I was told to get a letter from them for permission to have a DL issued. At least that is what I understood... which honestly, is nada. :help:

I need some advice about providing documentation required for a driver's license in Illinois. Illinois will not issue a driver's license unless a person can document that they can legally remain in the US for 6 mo. My wife entered on a k1 visa and my stepson entered on a k2 visa, at this point we have married but have not yet started the AOS process. Can anyone tell me what I need to present to prove to the state that my wife and stepson can legally be in the US for at least 6mo? What will it take, proof that we have applied for AOS, a successful completion to AOS or something else. Thanks for your help.

Vermont has the same requirement. We used the K-1 visa in her passport, a copy of our marriage certificate and the NOA from filing the AOS. It is unlikely they will issue drivers licenses if you have not filed for the AOS as the k-1/I-94 only "authorizes" a 90 day stay. Alla had her drivers lisence before she received her green card. They issued it for two years as the CGC is for two years.

It will be dependent on the state, but I would think the NOA would be a minimum requirement, it was here. They even had it covered in their "matrix" for various visas.

Forgot to mention...she also gave her SSN and we used a checking account (joint) statement as proof of residency. She did NOT need an EAD or GC, just the receipt that we had filed for AOS
