Driver's License for K1 and K2 Visas

Timeline

I need some advice about providing documentation required for a driver's license in Illinois. Illinois will not issue a driver's license unless a person can document that they can legally remain in the US for 6 mo. My wife entered on a k1 visa and my stepson entered on a k2 visa, at this point we have married but have not yet started the AOS process. Can anyone tell me what I need to present to prove to the state that my wife and stepson can legally be in the US for at least 6mo? What will it take, proof that we have applied for AOS, a successful completion to AOS or something else. Thanks for your help.

If the EAD is necessary for a driver's license then it will take many months before my wife and stepson can get their licenses. Do I have that right?

That's correct. In other words, they're asking for either an EAD or actual green card to even give them License Permits. There's no other way to prove that they are legally in the US for 6 months since their I-94s will expire 90 days from entry.

Thanks, this posting was quite useful as my husband needs a driver's license in NJ and we were told something similar when we went to apply - with no explanation of what form would fulfill this request. I am hoping EAD approval will suffice.

Timeline

Most states require a Green card to issue a Drivers License. They wont even issue a State ID that is longer than the I-94 being valid. I dont think EAD will suffice to get a Driver's License. i dont know all the states however and could be wrong. You need documentation that you can legally stay in the USA for a length of time. EAD just gives you permission to work. The Green card is what gives you permission to stay legally for 2 years or 10 years at a time, subject to renewal.

proof of residency... is exactly what the OP is trying to do and currently lacks any of the acceptable evidence types

Here in NJ:

EAD or GC are valid as long as you have a SS card. Plus proof of address.

Don't let the choices chose you, chose the choices that you want.

proof of residency... is exactly what the OP is trying to do and currently lacks any of the acceptable evidence types

proof of residency can be utility bill or chek book that carries the name and adress.

When did you apply for your DL? If I remember correctly, Texas just re-wrote within the last month or two all the rules regarding this issue....

The DMVNY State they asked you to show your green card,original ss card with you married name , Marriege Certificate and you have to take an exam 20 items only 5 mistake is aload to pass and pay the learners permit and wait for 10 days they are going to send you the card.
