I applied for my AOS with just my husbands last name because I didn't want to have my long peruvian name with 3 last names on the green card. Couldn't change it on the marriage certificate at the time of marriage a year ago. And now here the state says I can't change my name legally to the 1 last name until I have lived here for 6 months. I have lived here 2 months. So my questions is, should I call USCIS and tell them I made a mistake. I did the finger printing and they had a problem with not having ID with just the 1 last name. But let it go because that was the name on the file. Guessing that the paperwork will last 6 months anyways so maybe I could just not say anything until I apply for the name change in 6 months? Or is it too risky?

If I do call do you have the quick numbers to press so I can get to a person quicker? Thanks,

Do you have a link to the bolded information? It doesn't quite make sense because your marriage certificate is your legal document to authorize a name change.

It sounds like a peruvian marriage certificate that has 3 last names.... This she wants to change... She may have to seek a legal name change via her local court system

It is physically impossible to change my name for 4 more months. being here in the US in the state of minnesota it ewquires 6 months or residency prior to being able to apply for a name change. They do not allow ammendment to marriage certificates according to the outlets I can go through to have my name changed. So my only question really is if I should change the paperwork I mailed in to USCIS. Because it has the shorter version of my last name which is not correct or provable with any legal documents that my name is only on last name. What I want ="last" What I have = "last name de last" crazy huh? techincally 4 last names :( Can't fit my name on hardly any forms.

So please some confidence that this will be ok on the USCIS form or some advice to how to talk to USCIS about this. Would appreciate it so much.

If you have already sent in your documents there is virtually nothing that can be done. Calling them will not assist you. You may want to make an InfoPass appointment at the local office (in Bloomington).

Have you had biometrics yet?

You can correct the problem at the AOS interview.

Maybe different states have different laws, but the way I understand it is that once a woman gets married, she may begin using her husband's last name right away, without going through an official name change through the court. You don't actually need to have the new last name on the marriage certificate. Some states don't put the married name on the marriage certificate, just the maiden name.

*Again, this is the way I understand it to be, so it may not be 100% factual.

There may not be a problem to correct at the USCIS is she in fact gets them to accept it... If so, then she can correct her "legal" name via the the court system to match what she put on her AOS application which I believe is what she wants it to be.

Thank you, yes I made it through biometrics with just the 1 last name. Though it wasn't easy without ID to prove it. But there records showed just the 1 last name so they let it pass. But didn't know there was an AOS interview for green card with K3. But won't worry about it until then because there was a delay with the paperwork. They did a request for initial evidence on something they really didn't need. But was wondering if I should send back the paperwork with the long name or just the short last name. But will send in with just the short last name and assume the delay will allow me to change my name in time. Just needed some confidence that it was the right thing to do.
