Hi everyone! I submitted my package in jan of 2008. So far, my wife has her advance parole travel document, work permit, she's done her biometrics and we are still pending for the I-495. We want to leave the US and visit our family in Colombia, however my wife keeps hearing about other people leaving the US and when they try to come back with their "immigration documents", immigration will not let them in. Has anyone heard of anything like that?

I just got off the phone with two different immigration reps and both told me that as long as she has the advance parole travel document, work permit, driver license, and receipts of other pending documents, she will have no trouble getting through immigration.

I don't want to jeopardize anything. I want my wife to come back to the country, but we do want to visit our families in Colombia. Plus we have all the right documents, I don't think that we would have any problems, but then again I'm not immigration. Has anyone traveled outside the US with an advance parole document? has anyone ever had any problems getting through immigration? Thanks so much in advance

If entry was by K-1 visa then nothing to worry about, if by other visa and had overstayed, then YES the POE may deny re-entry.

She should be fine as long as she has her AP documents with her along with any other picture ID she may have handy.

My wife feels the same way.

Wifey is thinking if she travels outside the US alone and comes back even with all the documents:

AP, EAD, Passport, Marriage License, I-485 Receipt NOA1 (AOS)

She is worried she will be harrassed by immigration.

So we're not gonna let her travel outside the US by herself.

We're just gonna wait for the GC.

If it doenst come out til May of 09, then we'll use the AP.

If the beneficiary went through the entire process (meaning visa application, interview, entry, adjustment), and has done nothing illegal, there is no problem returning to the US using a valid Advance Parole document. Many many many of us have done so numerous times without any problems whatsoever.
