Infopass and the interim EAD

I applied for my EAD in Oct last year, receiving the NOA1 on 10/31/05. I'd heard nothing within the 90 days so I made an Infopass appointment this morning at my local Immigration office. I was told there that I had been approved and that they were just behind on the biometrics appointments. They only do these on a Wednesday morning, she said - but couldn't fit me in today. Could I instead fill out the I765 again and mail it back to them? I would then receive an appointment for the biometrics within 7 to 10 days of them receiving it. She gave me the form and wrote "Interim Card" on the top & stapled a copy of my NOA1 to it.

I then return home and find my NOA2, asking me to come back to their office on 3/3/06 for biometrics (even tho this is a Friday) for both the EAD and the AOS. Now, I'm assuming that this appointment is, in part, for the actual work permit and not an interim one. So my queries are these:

If I wait for the 3/3/06 appointment, would I walk out with my work permit there & then or is there a delay following this appointment to get the card sent to you?

Is there any mileage in sending back the form to receive an interim card in the meantime? If I get an appointment within 2 weeks and receive the card the same day (which is what they have told me), I will have at least 2 weeks before the actual biometrics appointment - maybe more if they don't process the permanent card immediately. As I already have a job lined up & they are waiting on my work permit, it amounts to some cash that could be handy right now.

I have tried phoning the 1-800 # for advice and obviously couldn't get hold of an actual person - just went around in circles ("Please enter your 10 digit receipt #." I do so. "I'm sorry, you have not entered the correct # of digits." Yes I ###### did!) I don't want to jeopardise my 3/3 appointment by confusing them in asking for another one, but if there's any chance of getting an interim card, even for a couple of weeks worth of income, I'm willing to try it.

Advice? Cheers.

There is a delay.

Since you have a job lined up, I'd go ahead and get that temp EAD as soon as possible. Did you ask the nice people at the DO if you can personally hand-in a completed & signed I-764 instead of mailing it in?

Well, I can try that, tho those security guards at the front door ain't lettin' no fcuker in without an appointment, and I wouldn't trust giving it to them to hand on. Didn't notice if they had a mailbox but I suspect that government buildings are wary of having slots in their front walls that anyone can shove things in. I'm not expecting to get an appointment next week anyway, maybe something the week after. Is applying for an interim appointment when I have an actual appointment already (albeit later than I had hoped) gonna ** with their minds? I don't know why she couldn't have told me in the morning - she looked my case up on her computer. I would have thought there would be a record of it, or am I crediting them with too much?

Right you can't get in without an INFOPASS appt. How soon can you get one?

They said 7-10 days after receiving the form, which they should have by now. Tho as this was from the woman with the computer who didn't know I already had an appointment there on 3rd March, nor that they also do biometrics on a Friday... well, I'm not holding my breath, shall we say.

How long is the delay after the actual work permit/biometrics appointment generally? A few days for them to shove it in an envelope & mail it to you, or more?

Steve,

If you have the Approval Notice you can show your employer that you are EA. Being EA, you have 90 days to produce the EAD (which the Approval Notice is not). The employer can hire you and you can start work now.

See I-9 and the instructions for Section 2.

Thanks Yodrak. How do I get the approval notice? They only told me I was approved on Weds when I had my Infopass appointment, but gave me nothing except the 1-765 to fill out again.

SteveLaura,

Perhaps I misunderstood when you wrote in your first post, "I then return home and find my NOA2, asking me to come back to their office on 3/3/06 for biometrics (even tho this is a Friday) for both the EAD and the AOS." VJ people normally use the term 'NOA2' to mean the Approval Notice, but I should have seen that you said the notice referred to both applications and contained the appointment info.

What does the Online Status for your I-765 say?

Lacking any hard-copy documentation, try telling the employer what you were told and maybe they will accept the verbal information about approval (perhaps along with a copy of the I-765 that you submitted).

I always get confused with what NOA means what...

Thanks again. I'll see if the appointment for the interim work permit comes up then take it from there. Cheers.
