Timeline

Well, you can file an I-130 and go for a CR1 visa. He will then have his interview in Mexico and he will get a ban which I believe is for 10 years or so for entering the US illegally. You then have to wait those 10 years before you can continue with the process.

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Oiga Diana --- I thought they would go for Adjustment of Status since he is already here; although the result will still be the 10 year ban.

My husband and I were in your same situtation. He has been in the country illegal since 1999. We have hired an attorney and filed teh I-130 petition for the CR1 visa. Your husband will have to return to Mexico once the I-130 petition is approved and you have the waiver hearing. There won't be a 10-year ban although some say it's possible. Our best friends just went through this process and he was only there about 10 days and was approved and returned to the U.S. immediately. So...... my advice is to consult with an immigration attorney and have him file the appropriate paperwork for you! Good Luck with everything!

06-04-2009 Notified by DHL that we were backlogged - told to wait 15 months

Currently waiting on an answer and to bring hubby home!!!!

Thanks...so is the CR1 included with the I-130 or is it seperate papers? Also, does he have to return as soon as it is approved or wait until the hearing is scheduled before returning? I can handle 10 days but too long of a time and we won't have a home or anything else by the time he returns

It's included....... the first thing you file is the I-130 petition. No, he doesn't return until his waiver hearing is scheduled. My husband and i are still waiting for that. We filed in April 2008 and still haven't heard anything. Ours is going through the Vermont Service Center which i have found out is slower than anyone can imagine. He'll have his medical exam in Mexico too. Again, you should seek the legal advice and help from an attorney! You can't go wrong with an attorney. That way you know that all the forms will be filled out correctly and takes the guess work out for you. Don't let people get you down with talking the 10 year ban. :star:

Yes, a qualified immigration attorney familiar with how things work through CDJ can give you a good idea whether a waiver will work and then spell out the process for you.
