hi guys. I sent my I-485, I-765 and I-130 Last oct 3, and believe or not but i have not received the biometrics appointment letter yet. I got the I-765 and I-130 approved. I call the uscis and they said that they probably have used the fingerprints and photos taken at the airport when I got to the usa. Before that happened I called the uscis like 5 times to see whats going on with the biometrics appointment but they wont give me a clear answer... (everything is ok, you have to wait, blah blah blah...) so today I got an email form the california service center saying that they can´t process my case until the have the biometrics... so guys, what shloul I do? keep calling the uscis or something? Thank you for your Advice

Hi mdc, why don't you schedule an infopass appointment and request them to issue the bio appt? Other people have done that successfully. Explain your situation and that you already have EAD approved and they should be able to help :)

This is exactly the same case in mine. I sent my packege on Sept 27 and my EAD and AP were approved on Dec 5, but still I haven't received my bio appointment letter yet. I wondered why they approved my EAD without figer prints, but after your story it's starting to make sense...

I'm not sure if it would be a great idea for you to go to the Infopass appointment at this point, because when I went to my Infopass appt last month, the officer wouldn't listen to me after she had noticed my NOA date was October. She just told me to come back on January, 90days after NOA date, she didn't give me any infomation. That was so disappointing and waste of time.

I understand it totally depends on the person and now you have your EAD approved, so you may get the right person and a good result. If you take an Infopass appointment, I wish you good luck!

The EAD is the Employment Authorization Card, you will need that if you want to work before your green card is processed. If you filed the I-765 form, then you applied for the EAD as well :)

The SSN is a completely separate process and you will be able to apply for it at the Social Security agency close to you when your EAD is approved.

As you can see he sent his toward the beginning of his package but if thats true he didnt have an EAD approval then, so its a little confusing. On the form it ask if your are a legal alien approved to work...I mean if I do it now should I check that? He already received his SSN card but without EAD approval.

Timeline

The SSN can be given also if the person is in the Country on a work visa (like me). I had my SSN card in 2004 when I first entered the Country, but I still filed for the EAD because my work visa expires in April 2009 and didn't want to take any risks. Also, some SSN offices are "better" than others. Some allow the SSN to be issued with the NOA proving the AOS process has started, others want to see the EAD first..

I just wanted to add that K1 visa holders have a work permit stamped on their passport valid for, I believe, 90 days. That alone should be enough to request a SSN card, if done right away :)

This isn't true. Most of K1 visa holders don't. There are some points of entry that sometimes give a EAD stamp to the K1 holder. the only airport that does it consistently is JFK in New York, the other ones don't unless you are lucky.

I don't know for people who came here on different visas, but K1 holders can get a SSN even if they don't have an EAD yet. I got mine in October. But I still have to receive the EAD in order to work. dj_osmo, if you don't have a SSN yet, when you receive your EAD you can go to a Social Security office and they will issue you a number in 2 or 3 weeks (or longer, it's like USCIS, you can't know for sure how long it takes :P)

Only a few K1s have the work permit stamp. It is only given at JFK airport if you enter the US there on your K1 visa and if you ask for it, as posted above.

K1s are authorized to work based on their class of admission as far as getting a social security card. They can get the SS card, but they can't actually work until they get the EAD. This document gives more information. https://secure.ssa.gov/apps10/poms.nsf/links/0100203500

From the document:

Required evidence for employment authorization is either a Form I-94, Arrival/Departure Record, showing a class of admission that indicates the person can work without specific DHS authorization (RM 00203.500C.1.) or an employment authorization document (EAD) (Form I-766 or I-688B).

If you scroll down through the document to PART C, there is a chart showing who is work authorized by their I-94.

Hope that helps clear up some confusion.
