I applied for my wifes EAD only. Being that she overstayed it was not worth taking a risk with the AP. She came on a B2 visa in 2006 and we lived together since then.

I think our situation was really complex.

1st- I got my divorced finalized this year.

2nd- My wife overstayed her stayed her B2 visa.

Wasnt the ideal situation but we wanted to be together and i couldnt keep getting the time off to travel.

As for delay in divorce- my ex-wife was really not cooperative with settling on anything.

I submitted evidence of bonafide marriage

-included pictures, notorized affidatites

Also included certified copies of divorce decree and all relevent tax papers.

Just hope that the interview goes smoothly kinda worried about her overstaying so long.o

I just received a letter to say my interview was cancelled and sorry for any mistake...............and that I should receive another letter to confirm with a new date or something...

I posted about this your other thread - for those who get canceled - there have been a few people who had their interviews canceled so they didn't go and they had their application canceled.

the general wisdom on VJ is to go the canceled interview anyway.

If and when we get an interview and if and when it's canceled that's what I'm going to do.

R

i-710 Process

02/23/2011 - Mailed off i-751 to California

You know something, you're right - it's good advice to go along to a canceled interview anyway and the very least they can do is turn you away. Better that than get a notice in the mail saying that you failed to appear...Alxmrt - why don't you plan on going anyway?

I agree 100%, it seems like the rule of thumb is, even though you received a letter saying your interview got cancelled, its best to still show up because, if you dont show up, your consider a no show and your application gets denied, so I would definately show up if I were you.

Hey kingtmac thanks for replying back. I think that everything will work out for the both of you in the end.

How long was your wifes B2 visa good for? I think homeland security are concerned about people who came into the US illegally, and are working illegally, but since she came here legally, and you both are doing things legally, no fuss no worries.

I assume you both got married in the spur of the moment. You also mentioned that she overstayed on her visa, usually when a non-citizen who is married to a US citizen, an overstay is forgiven.

My wife and I sent in the same evidence of bonafide marriage, but we also included life insurance for now since we have only have been married for 6 months. We are definately building up more evidence in the meantime. I think your interview will go well.

after reading previous posts i'm going to show up on that date even if i get a rescheduled appointment in the mail. It was a shock today and started a panic....

You have nothing to lose by showing up on the date you were scheduled, better to show up and than to be a no show.

Congrats to all those moving on!:dance:

Quick question here...

To sum it up I got a yellow RFE regarding my sponsor and joint sponsor. The three check boxed points were...

1-In order to process your application further the petitioner/sponsor on form i-864 Affidavit of Support must submit all federal income tax documents submitted to the Internal Revenue Service for the most recent tax year.

2-In order to process your application further the joint petitioner/sponsor on form i-864 Affidavit of Support must submit all federal income tax documents submitted to the Internal Revenue Service for the most recent tax year.

3-The joint sponsors income on the federal income tax return does not meet or exceed 125% of the poverty guideline. The joint sponsor lists their current income on form i-864 as an amount to be considered as sufficient; however no evidence has been submitted as proof of current income.

In order to process your application further submit evidence of joint sponsors income. Such evidence should include...

Letter of Employment.

Pay Stubs.

OK. So on 1 and 2 I had previously submitted just a one page tax return summary which had their name, Social, and tax paid summary for the most recent year. Thought that was all I needed! Clearly not. So now i have photocopies of all their previous year tax dealings which I will mail in which are very long in my joint sponsors case. Is this right? Did you all mail the one page of a whole slew of pages for the most recent year. Also thanks to the advice about IRS Faxing!!! Never wait for them to mail it to you I was told. And thus I changed it Fri to a fax! They never initially offered that and I should have asked.

But the funny one is point 3 above. It even contradicts itself!? I mean, who is typing these things? I mads an example letter of employment and am going to have his boss sign it. Thing is, he makes well over $100,000 grand a year but no pay stubs as he is a real estate broker. Letter of employment looks like this....

RE: Employment Verification For ___________

Dear Sir or Madam:

This letter is to confirm that _________ is currently employed with ___________ in ____________ and has been since May 2006 on a full time basis as a real estate agent. His salary exceeds $100,000/yr. Mr.____________ current employment is stable and is likely to continue far into the future.

Please feel free to contact us should your office require any additional information.

Sincerely,

His salary changes depending on how many houses he sells. Is this sufficient?

Think this is all these bozos need? Am I missing anything? Did I mess up anything else and am not seeing it? I cant possible handle another RFE!

Thanks ALL SO MUCH!

Hey Tony, I hope the info you sent will be suffice with USCIS. Good luck buddy.

That is fantastic news Rosie, I am very glad to hear you got answers, I love to hear stuff like this. I am in the same boat as you are, I am waiting for the EAD and the interview letter as well. I am just amazed that, our group is already receiving interview notices, I believe its a total of 5 interview notices so far. I hope this happens for other people in our group.

I'm with you, Canadianmade - I am amazed too by the speed of some of the interview letters in this group! Wow, it almost makes me a little nervous to think about it!!! I'm not expecting one anytime soon, though - don't know why but I just have a feeling I may have a long wait! On the other hand, I DO want my EAD though! That would be wonderful!

Thank you Beantownbabe, I just think its so crazy, their are other filers who posted before us, like for example the july filers, who either didnt receive their interview notice or just did but it is in december or january, so that says alot. I am hella nervous about this too. Why do you think you wont be expecting one anytime soon? Why do you think your journey will be a long one? When do you think you will get your EAD? What line of work are you going to get into when you get your EAD? I just dont want to get RFE and it would be cool if us filers got our green cards came fast. I know some will get theirs faster than others.
