Hi all,

I sent my wife's AOS package off to Chicago a week or so ago. Due to work and the new baby, the process took a little longer than intended and I guess I missed the deadline of August 31st for filing with that version of the I-765.

So, yesterday I got an NOA for the whole package, telling me to wait for a biometrics appointment letter, and I also got a separate NOA saying the I-765 form was rejected because it was old (old by three weeks!). No problem, they just said in the NOA to fill out the new form and get it back to them, which isn't a problem at all.

However, what the problem is, is that on the USCIS site, they haven't updated the new form!

Has this happened to anyone else? I called the service number at the bottom of the NOA and did the recording bit where I requested a new form. Hopefully this works. I'd not like to waste any more time on this if at all possible.

Is there anyone out there with a pdf of the new form? If so, where did you get it? I know, I know, I should only get the forms from the USCIS site, but they're lagging on this one!

I don't know what the problem is, the form on USCIS matches their list of most recent forms.

The date you are concerned with is at the bottom of the form NOT the OMB date.

"OMB No. 1615-0040; Expires 08/31/08" is NOT the expiration date of the form, is the date that USCIS needs to compleate an audit of the form to satisfy the requirements of the Paper Work Reduction Act, per Office of Management and Budget. OMB You can read about Paperwork Reduction on page 12 of I-765 form's instructions.
