Does having a NOA2 guaranteed that case has been approved and would not have other possibilities of denial? How would the case run after receiving it? How was the chance? And how sure is sure? Thanks!

Having an approved petition from the USCIS is just the first stage. There are security checks at every stage of this process and you can get held up at any point.

Some Consulates are much harder than others but as long as you are a true couple and supply the USEM with what they need you shouldn't have a problem in PI. Do yourself a favor and visit the PI regional forum and read through Sheriff Uling's guide for K1's through PI. ;)

Hi, NOA2 means that you the petitioner has been approved to petition the foreigner. You have survived name checks and background checks etc. You get this permission on the USA side of the process here in the states.

Then the case is sent to the respective country and the US embassy there focuses on the foreigner. At that stage the petitionee can be approved or denied or just placed in a limbo fro awhile so the US embassy can sort thru things.

its entirely possible to be approved with NOA2 and then be denied at interview or after overseas.

however an extremely small percentage is denied under the K1.

And most are denied either from overstays and bans to the US or from the medical, drug history, criminal history, etc. or they werent legally free to marry at time of filing ( previous marriage not annulled or divorced).

If you have any specific questions, feel free to PM me. My wife is from the Phils so i did the route you are going.

Chris

Good question! I believe I either posted a question like this or asked / pondered on the possibilities of this matter.

The answer is, Yes, absolutely! The NOA2 does not guarantee anything. It just saying that your petition was approved and that you can file for the K-1 visa. This is like the first step. USCIS will send your paperwork to NVC (national visa center)... and they will give you a MNL Case # to be forwarded to USEM. And yes, it takes months to get that, depending if you are from CSC or Vermont. (CSC usually is more backlogged)

Now what things can go wrong during all this time...

Well, Like what Chris said.... There can be a number of things. Like... If your fiance does not pass document verification.... (NSO will check if she has been married before etc) (this is before the interview or after the interview)

If you did not pass NSO DOC VER check, no K1 visa will be given.

Also, you need to be able to provide an affidavit of support. Getting sponsors for that if your income isnt enough.. etc. Look for that at the K-1 Visa Guide before the interview.

Plus, there's a Medical Check up at Saint Luke's... Checking if you have AIDs/HIV positive. or Tuberculosis.. etc.

Lastly from what I can remember, there will be more checks with USEM in Manila for documents and your relationship. Your fiance will have to go to the interview (with or without your precense).. ETC.

Now, if any of these were missing or invalid. Then you cannot be issued a K-1 Visa. or it expect it to be delays.

Looking at your timeline, if you do not get any RFE's, you might receive you NOA2 by December/January.

I suggest right now since its just the beginning of October, that you just sit back and relax.

Sign up for USCIS website for your case # so you will be updated if there are any updates on your case.

Also, check on visajourney... it helps if you know whats going on and about...

Good luck! Any questions, send me a PM.
