Good morning All:

My husband told me a stituation that happened to his bredren there in the states and I dont know the answer to this.

He came to America on a visitors visa, overstayed his visa. Hanged out with the wrong crowd. He did some crime and his cell phone fell out of his pocket. Police found it. They arrested him. Now police has a search warrant to search the house he has been staying. Now he is a holding cell. Will he be deported back to Jamaica? Under what grounds can he stay in the USA?

In Canada if he has a good lawyer, or a child/wife the.outcome is good. but he has none of those.

1luv, is he married to a US citizen? What type of crime did he commit? Lots of factors in there, but I would say it is highly likely he can't stay under any grounds = especially if the crime falls under the "moral turpitude" category - which is so broad and vague it's just about anything. Basically, being convicted of anything that could result in more than 1 year jail sentence, whether actually served or not - literally 366 days -

He is NOT married to a US citizen. I dont know what the crime was. I honestly think that they are going to send him back home. He will have a lifetime ban right?

He's going to get deported...even if he gets an "immigration lawyer" he's going to get deported. Best if he leaves voluntarily. I hope he has a current passport.

See I was telling my husband that he is going to deported! He has been in the States for 3 years and not straight. WUKLESS!! :angry:

Quick update. I'm in the US and POE was a breeze. From the plane to the outside (bags collected) was approx 25 minutes. It's never been that short for me in regular travel!

I posted a POE review with details. I'm happy to be here and can't wait to see hubby this weekend! Night night to you all and thanks for the constant support. :thumbs:

I would say slim to none. Overstay + crime = eventual deportation.

He's definitely going to get deported - and very likely a ban - especially if drugs were involved.

If drugs, maybe lifetime. If not, it could be just a 3 or 10 year ban.

Good morning. My friends boyfriend has one of the green cards that have no expiration. He wants to come back here. 1. Doesnt he need to get that changed over to the 10 year kind? he has had it since a child 2. He has been in Jamaica, i want to say since end of 2005. What does he need to do to get back to the USA? I was reading about the re-entry permit, I-131 however that one appears to be only for if you apply in advance to stay out of the country before you leave the country. So at this point, what are his next options if any. He attempted to go to the airport to come here and they said no sir. Any advice? What agency should she call to find out more info if any. I have been looking on the net trying to find something that advises what to do if you have been out of the country more than one year. :wacko:
